possibly being deny

Hi everybody,

I have been around the forum for about a year just reading, you guys are great and have been a tremendous source of information.
I was wondering if anybody has been approved for I130 but deny on the I485.
I came with my mother as a little kid and I don't have proof of how we enter. All I remember was coming across a bridge at El Paso where we were inspected and mom said we were going shopping. Just recently we received an intent to deny letter for the I485 and at the same time we received a letter saying that the petition or I130 was approved. Any thoughts or comments are greatly appreciated.
 
I130 can be approved even if you came here illegally. It's approved on the basis of the relationship (spouses, children, parents of US citizens/residents). Now, I-485 cannot be approved if you cannot prove that you have entered legally with an inspection.
 
Thanks LucyMo, so I guess my question is, why not just deny both? what is the purpose of approving one and not the other?
 
like I said - the I-130 is based on your eligibility for a visa number (your relationship to your sponsor). If the relationship exists, you are eligible for a the visa number. However, approval of I-485 depends on your eligibility to adjust status. Those who came here illegally are not eligible.

you heard wrong. If you entered illegally, then the way you are related to a USC doesn't matter - you can't adjust.
 
Wow you guys are great, however I don't think I made myself clear. We were inspected in El Paso, but I don't have proof I was only 12 my mother is no longer around and immigration can not find record of my entry in 1982. so how can I prove my entry.

Wait 1982? If you can prove you came in 1982, why didn't you apply under the 1986 amnesty?
 
Thanks for the responses. I didn't apply in 86 because I was in foster care still a minor didn't know what to do.

You might be eligible, I don't know. This seriously is a case where an attorney will probably be required to determine your options and the consequences of each possible avenue.
