Possible concurrent adjudication of I-140 and I-485

I honestly can't tell if the below is an April Fool's Day joke (it says at the bottom it isn't), but I'll post the link here and if people see confirmation of the same information posted elsewhere, perhaps it is true. If so, it sounds like a good thing, although there are still some vague points.

Immigration Alert: USCIS Experiments With Two Pilot Programs: Concurrent Adjudication and Expedited I-551 Production

The California Service Center (“CSC”) Director, Don Neufeld, announced at a March 31, 2004 American Immigration Lawyers Association (“AILA”) liaison meeting that the United States Citizenship and Immigration Services (“USCIS”) is implementing two new pilot programs to increase adjudication and processing efficiency.
Expedited I-140 and Adjustment of Status Adjudication

In the very near future, the CSC will attempt to adjudicate all new concurrently filed EB-2 I-140 petitions (excluding National Interest Waivers) and I-485 adjustment of status applications on a concurrent basis. This would include I-140 petitions based upon a labor certification application that requires at least a Master’s degree, or a Bachelor’s degree followed by five years of progressively responsible professional experience. Instead of a prima facie review, the I-140 petition and concurrently filed I-485 application will be adjudicated within 90 days, provided fingerprints and name checks are cleared. The CSC will also target previously-filed EB-2 I-140 petitions (excluding National Interest Waivers) with the goal to match the pilot program’s 90-day processing timeframe.

Additionally, the CSC will concurrently adjudicate pending adjustment of status applications and I-140 petitions in all preference categories to decrease processing times to less than one year. The CSC expects little movement regarding petition processing for I-140 petitions that are filed without an adjustment of status application. Finally, the pilot project will be implemented at the CSC only.

Expedited I-551 Processing

The second pilot program, already in progress, involves Form I-90s filed electronically by permanent residents in the Los Angeles district. When an applicant appears at an Application Support Center (“ASC”) for biometric processing, the ASC will automatically cause the I-551 or Permanent Resident Card (“green card”) to be manufactured and mailed immediately to the permanent resident. The green cards will not be produced at the ASCs, but the ASCs will be directly linked to the card facility. Again, this applies to electronically filed Form I-90s by applicants in the Los Angeles district only. Note that Form I-90s for children turning 14 cannot be filed electronically.

It is expected that the USCIS headquarters office will soon release more details regarding both of these pilot programs.

How This Affects You

According to recent reports, although the CSC is adjudicating employment-based adjustment of status applications filed at the beginning of January 2002, many cases are still pending that were filed in the summer and fall of 2001. Efforts to reduce the USCIS’ I-140 and adjustment of status processing backlogs has been long anticipated, and announcement of the expedited processing program on April Fools Day is merely a coincidence.

Pilot programs are usually pick nad choose... and sample 2-5% of applicants. it will take a while to implement it for the whole system
hard to believe. But i want to believe.

04/01/2004: Hey, Step Aside "Concurrent Filing," "90-day I-485 Adjudication" is Looming Up!

* According to the AILA, the USCIS is launching two interesting pilot programs to complete adjudication of I-485 applications within 90 days of filing. This is not a April 1 joke.
* In family-based I-485 cases, Dallas Local District of USCIS will launch such program beginning from May 3, 2004. The I-485 applicant will be "interviewed at the time of filing" and adjudicated within 90days. FB-485, DV-485, Special Immigrants-485 will be covered, but Asylee/Refugee-485, EB-485, and LIFE Act-485 will not be covered. Wow, the families and DV lottery winners should move to Dallas! It is hoped that people in Dallas USCIS jurisdiction are not exploded with flock of married couples, the relatives of U.S. citizen, etc.
* In Employment-based I-485 cases, California is reportedly about to launch such 90-day adjudication program for EB-2 concurrent-filing cases. NIW-based EB-2 will not be covered by the pilot progam. Remember that the eligible cases are non-NIW EB-2 cases of concurrent filing of I-140/I-485 only. In EB-2, if you file NIW case, you are out. If you file I-140 for non-NIW EB-2 but not concurrently with I-485, you are out too. Only currently filed cases will be covered by this 90-day I-485 adjudication pilot program. Since the concurrent-filing rule requires that the I-140/I-485 be filed at the jurisdiction of I-140 petition, meaning the job site or place of employment, the people who obtained a labor certification approval for the job sites outside of the California Service Center jurisdiction should not attempt to flock into the California Service Center by selling their homes in other jurisdictions and moving into the CSC jurisdiction. I ain't going to work! Interesting question which has yet to be answered by the California Service Center is "undetermined location" labor certification cases. These cases are filed not at the location of job or place of employment but the location of the main business office of the employer. Accordingly, should employer's main office be located in the California Service Center jurisdiction, no matter where the roving job will be located, such EB-2 filers are allowed to file at the California Service Center regardless of their job sites and location of residence, and theoretically, they should be eligible for such pilot program privilege. It Ain't Interesting?
* What do they mean by "pilot program?" Common sense tells that it means a testing of certain program to test the water. Overall, pilot program will give a hope to all the I-485 filers, including family-based and employment-based, in that eventually, it will reduce the I-485 processing times tremendously throughout the country. Apparently, it is targetting at achieving reduction of processing times at one year across the board in the near future. Since it will include the time for I-140 and I-485 together, it ain't bad at all! Hold your breath!!!!!!!!

Starting shortly, CSC will attempt to adjuducate all new concurrently filed EB-2, non- National Interest Waiver, I-140s and I-485s on a truly concurrent basis. Instead of a prima facie review, the I-140 will be adjudicated within 90 days, together with the I-485, provided fingerprints and name checks are cleared in time. The CSC also will be targeting previously-filed, non-NIW EB-2s, in order to bring their processing times down to match the pilot program processing. Additionally, the CSC will concurrently adjudicate pending adjustment/I-140 applications in all categories, in order to bring processing times to below one year; however, AILA was told to expect little movement on lone-filed I-140s during this push. This pilot project will be at only the CSC at this time. It is expected that HQ will release more details on this project shortly.
 
I am a bit bothered by the fact that I-485s filed after I-140's approval (which constitutes the bulk of "old timers" here) are not addressed. But, hey, if the ultimate goal of reducing the wait time to a year by end of fiscal year is achieved, I am all for it.

It looks like only EB2 category will be benefited out of this pilot program. EB3 category has to still wait for 1 year...

I'm not sure what's meant exactly by the following statement:

It sounds like if your 140 is currently at the CSC, when they adjudicate it, they will also adjudicate the 485. But what about for people whose cases have already had the 140 approved, but their 485 is still pending?
 
This is not for people who have filed non-concurrently.
But i am sure they will come out with a similar pilot program.
They ar arrogant but they are not stupid.

Will this new pilot also retro-actively apply to us thousands who have applied I-140/I-485 in the last two years and are still waiting. Or will this just be for the new applicants? Its going to be real sad if its just the latter.

We weren't allowed to file I140/ I485 concurrently , and now who have applied after us ( after a loooooooooooooong wait of 18 months ) will get approved .That is totally unfair !!!!!

Grossly unfair that this cannot be retroactive, especially when 01 guys
are still waiting...

It is incredible that legally CIS is not expected to approve in FIFO
order ( or atleast consider for approval in that order... )......!

I am on my 9th year H1.... very frustrating.

Well i chose to cash in at startups instead of GC, paying the price,
i guess...

Last time they talked they said they did not have resources to reduce backlog and now they are talking about 140_485 adjucation in 90 days. This is just a publicity stunt. Who ever came up with this idea deserves a 5 feet bamboo in his...

The message also appeared in the News Ticker of Carl Shusterman's website (www.shusterman.com). The news there does not talk about only for concurrent filing (I140/485) cases. It talks about "processing EB-2 I-140 and I-485's in less than 90 days if not national interest waiver is involved." There is also a statement "The CSC will start with newly filed cases and then process pending cases." This is damaging. Guys who have applied 3 months back will get approved and we the 24-27 months applicants will keep on posting "Congrats." This is so ridiculous. So, now they'll move back from 2004 to 2003 to 2002. Wow!!! what a great idead!!!! :(
