Porting eb3 to eb2 timeline

My husband's I-140 was approved back in May, 2011. His lawyer sent an email/letter to US CIS asking to port his eb3 to eb2. After a month of waiting our lawyer sent another request. US CIS officer said that we would have a decision by August 1, 2011. On August 2 our lawyer re-contacted US CIS again. It's been a few days and we still didn't get a response. We were told that US CIS in Texas is very good about porting. I'm just curious what is the average wait time for the Texas office.

I would be greatfull for any input.

did your husband EB3 I-140 was approved in past and I-485 was filed on the base of EB3?
Did your husband got NEW I-140 approved in EB2 in May 2011?

*** Your lawyer is just sending emails. He should draft a letter and make the request according to Situation. May be you need to INTERFILE copy of new I-140 approval with Pending I-485(I dont know your full details)
