Police certification verifying absence of criminal conviction

Hello Everyone,

I am planning to apply for Canadian PR shortly.
While drawing up a list of documents I noticed that applicant needs to get police certification verifying absence of criminal convictions.

I had a question for Indian nationals out there that have gone through this process. Can anyone please tell me what exactly do I need to get from Indian Police ? I would also greatly appreciate if anybody can also share how they went about getting this document.

Read form properly

If you are Indian national applying from Buffalo you dont need to send Indian police certificate. Please read form properly.
Even if u need u can apply at Indian consulate in ur area. You will need to give them ur passport. If passport is issued from that consulate it is fast or else it can take 2 months as consulate needs to contact the passport office which issued ur passport.
But as per my first sentence u dont need it.
 
U do not require to submit police clearence from India

If u r applying from Buffallo u have to submit FBI clearence and it is very easy to get it from here. U just send an application for requesting Fingerprint card from FBI office(u'll get the address at www.cic.gc.ca) U'll get the cards within 15 days.
After getting FP card go to ur local police station, show them State ID or Driving license. They will take ur fingerprints on those FP cards. It will take only 5-10 mins. After that mail those FP cards to FBI office with money order of $18/person.
And within 15 days u'll get ur FP cards with stated that " No arrest record found(if u dont have conviction)" and send those FP cards to Buffallo office.
 
If Indian Citizen no need of Police certificate from India, CIC knows that even criminal can get a letter of no conviction from India
If you are in US you have to send FBI clearance as posted above
 
Now even FBI Fingerprinting clearence later

As of ppl applying after 1/1/2003 when new forms and instructions were issued from Buffalo, even US FBI clearence has to be submitted LATER when requested by Buffalo not during time of application.
However if you have lived in some 3rd country apart from US & India you will have to submit those police cert at application time (ex if u have lived in UK etc).

Do you know anybody who had earlier been working in UK on work permit, applying for Canadian PR ? I need some info on it -- I know there are instructions given in the CIC guide which speak to that ... but there seem to be some unclear areas.

Yes infact I had to myself as my wife was studying & working in the UK for 5 years before our marriage and her moving with me to the US.
You need to send a cheque of 10 pounds along with a form and your passport copy and original drivers license. Forms can be downloaded from the net and have clear instructions. Please send it by registered mail to make sure it has reached.
One issue was they want original drivers license as proof of adress. In my wifes case I sent them the receipt which she had received temporarily from DPS before the original came. You can also request duplicate DL first and then send original if you are worried about loosing it.
The office will first send u receipt with file number and the actual subject acess form later.
Let me know what the unclear portions are for you and I will try responding.

It's a relief to have you throw some light on my UK confusions.

To answer your last question first ... no file number yet.

Next, my questions on UK.
Background: I was in Peterborough, Cambridgeshire, England 94-95.

(1) Address to send to :

CIC says to send to London Address "Subject Access Office, Metropolitan Police, 10 The Broadway, London, SW1H 0BG"

3019A online form says to send to "The Data Protection Unit, Room 879, New Scotland Yard, Broadway, London SW1H 0GB."

Metropolitan Police FAQ says:
"Please note that we will only be able to provide you with information if you live or have lived in the Metropolitan Police area (most of London). If you live or have lived elsewhere you should apply to the Police Service which covers the region or area concerned." I figured out the Cambridgeshire Constabulary address.

I was wondering which of the above 3 addresses to send it to.

(2) It appears from 3019A form directives (and seems to be re-inforced by what you mentioned) that just the form accompanied by notarized passport copy and proof of address in US will do. I was wondering whether any proof of the stay in England in general and in Peterborough in particular, is necessary -- basically I have NO proof (no bank statement, employment contract, rent receipts etc) -- all I have is the immigration and work permit stampings on passport -- but nothing which explicitly ties me to Peterborough. That shouldn't be a problem right ? I figure neither did you have to show any extra documentary evidence.

I applied to the Met police at Broadway adress as my wife was residing in Metro London area.
Basically this is what happens. You apply to office which has jurisdiction where you lived. They then forward the form to National Identification Service @ Scotland yard in London. So eventually the final letter you receive is from them. Their tel number based on the final letter I received was

Fax 020 7230 2688
youneed to request Section 7, Data protection Act 1988, Subject record prosection conviction history.
I would start with eiother calling/faxing them or Cambridge Constabulary office and requesting form.
As far as form, you will have to enter adress of where u lived in the UK. I did not send any proof myself but yes the payment I made of 10 pounds was drawn on a british bank in which my wife still has acct. But that should not really be material as you may be able to send pound denomination check from bank/Thomas Cook in US etc. Maybe you should just call Cambridge police and speak to the subject acess officer there.

Yes I will start with the Cambridge constabulary, I did talk to someone there and got the address to send to.

Would like to confirm with you that it is the 3019A form that you had sent (in addition to the pre-printed letter from CIC stating the requirement of Police certificate).

Not 3019A form but 3019 B

I think the info in CIC brochure is old and outdated.
The website of Met Police specifically stated to use 3019B for any visa or immigration purpose. I used 3019 B. That is the correct one.
I am not sure of 3019 A but that is not the right form and thats not what I sent.

Indian Police Certificate

Hello Friends,

I am planning to apply for PR in Canada and have one more question regarding Police Verification from India. Where in the forms or in the Buffalo Immigration site does it say that Police Verification from India is not required ? I could not find this anywhere - is it just a generally known fact ?

Just wanted to make sure that the rules have not changed and the Indian Police verifications are still not required today.

However, I see now that they have taken out the list where they instructed about the countries not to get police cert from (among which was India).

Most probably they revised it in June as the left hand bottom corner of the pdf says 6-2003.

I would contact the Indian Consulate/Embassy in your jurisdiction

I see now that the list of countries is no longer there. I applied 2 months ago and the buffalo specific instructions have changed already. For Indian police certificate I would contact nearest Consulate/Embassy.
If your Indian passport is issued/renewed in US it will be very fast if from India it may take a month or two.

I called the Indian Consulate here - there is an application form for Miscellaneous Services in the web site which needs to be filled out. A copy of the passport (the form says original is required but the lady on the phone said that copy would be fine) needs to be sent with the application. I think the fee is $40, but the form is a little vague about this, so I need to clarify this again. Seems it takes around 6 weeks for the certificate to arrive.

Wondering if the Canadian Immigration rules rules have really changed and the Indian Police certificate is required now, or is it just that they do not mention it in the forms any more and it is still not required. Most probably the first is correct, hope there was a way of finding out for sure.
