Please what is j1

And it requires a 2 year of being at you native country before you are able to apply for a new visa. The 2 years are really 2 years...if you go back on a tourist visa for 2 months, you still have to add the 2 months so the 2 years is really 2 yrs.

Bentlebee I have mentioned this to you earlier:

Exemptions are possible, I received an exemption so I could remain in the US when I applied for an H1B from a J1.

There are five statutory bases upon which you can apply for a waiver of the two-year foreign
residence requirement:

1. a no objection statement from your home government,
2. a request from an interested U.S. Government agency on your behalf,
3. a claim that you will be persecuted if you return to your country of residence,
4. a claim of exceptional hardship to a U.S. citizen or permanent resident spouse or child if
you are required to return to your home country, and
5. a request from a state public health department, or its equivalent, on your behalf (only
applies to foreign medical graduates who obtained J-1 status for graduate medical
training or education).

Every case is or can be different, and I only mentioned the basic rule....if we have to describe every single possibility then all our answers will be way longer...perhaps we should also incl. all possibilities of denials since there are also many reasons....

IMO the OP asked a general question and for all specific questions pointing to any OP's case, you need to know all the ins and outs and be a lawyer which probably only the owner of this forum is....the rest of us are all trying to give simple answers as honest and good as we can.

The 2 year rule can have big implications ( it would have for me) and I didn't point out every single scenario, just one: exemption from the 2 year rule.
