Please Urgent advice needed!

Hi there,

I'm on F-1 Status & applied for asylum, i got Recommended Approval few days ago. DO I NEED TO MAINTAIN F1 STATUS TILL I RECEIVE FINAL APPROVAL???

My F1 status will end soon, what happens then? do i need to extend it? can the USCIS issue a final approval if i am not in F1 anymore? or will they send the application to a judge & everything starts from zero?

It is not necessary for you to keep your F1 status. You can leave school or go to school parttime and work (you are eligible to get a work permit due to your recommended approval).

The only wrinkle is that if you do not keep your student satus and if they are not able to approve your asylum application, you will have nothing to fall back on.

I understand from your advice that its not a must to be in status to be granted asylum by USCIS after Recommended Approval.

being out of status is not a reason for not approving the case?

The vast majority of applicants for asylum are out of status.

If I become out of status will i be under removal proceedings?

(((( Basicly is it OK if i lost F1 & become out of status while i have recommended approval )))) will i be able to receive Final Approval later.

Its because i have almost finished my course & due to family issues.

Once again most people who apply for asylum are out of status. They will be placed into removal proceedings if the USCIS does not grant their asylum cases. If the USCIS grants their asylum case then they will receive approval letters and their lack of lawful status is not a relevant factor.

It is entirely up to you if you want to keep the student status. You have to make the decision yourself. Again the most obvious risk is that if you give up your student status and if after the background check they cannot grant your asylum case then they will place you into removal proceedings.

What kind of information will they discover in your background check? You can best answer that question.

Seriously if something so negative turns up as a result of the background check they will not want you here as student anyway.

Also the few students I knew jumped at the chance to work and make some money when they got their recommended approvals.

Again you need to make this decision yourself and if you hesitate you should consult a lawyer. As you know, no body can give you legal advice here.

I have really nothing to worry about the background security check other than the factor of time it might take.

Therefore i will go ahead & work hoping to recieve final approval in the near future.
