please suggest a good Attorny to discuss employment contract

Sorry to ask this question here.

I would appreciate if you can suggest me a good lawyer to discuss the effects of breaking an employment contract. My wife has 3 years of employment contract which we are planning to break due to personal reasons (child birth).

If you have any experince with breaking employment contract please share the information. In my wife's employment contract they are asking for $xxxxx to meet the expenses incurred by the company.

3 yrs Contract

It is insane to have a 3 yrs contract. I broke my 1 yr contract after 10 months.
Reasons for my breaking the contract:
They were not paying me as stated in the contract.

The amount they are asking, did they really spent that much on your wife and as well how long have your wife worked with the company.

Give them the good reason to break the contract and they won't probably come after you.

My previous company issued me summons and I hired a lawyer and they withdrew the case. I paid nothing to my company. In which city and state you are and how big is the company.
 
You may not have to break the contract.

If the purpose is to take some time off due to child birth, just ask for some time off. It may be without pay, but they cannot refuse you to get time off, even if you want 6 months off.
Ya, if they do not want to wait 6 months for your wife to come back to work, they can fire her and still you would not have to break the contract. ;)

e3umcd, answers to your questions

1) All they spent is the GC expenses for her. She is working as a RN, so they must have spent some money on job related training too.

2) The employer is a big hospital.

EricS, I have one more question to you.

is there any supporting law to request unpaid leave on the ground of child birth. They gave her only 6 weeks unpaid vacation, and when she asked for more they refused. Also when she asked to reduce her working hours they refused it saying that it is not allowed as per her contract. (She is working as RN, so they have all flexible work hours, but only because of this stupid contract we are stuck)

Apply for short term disability due to family/personal reasons.Generally you can apply for 2weeks - 6 months . Infact if she is full time, then they have to pay her atleast 50% pay.They cannot deny it and ofcourse they cannot fire her either.

My suggestion would be....apply for a formal short term disability (See if you can get a medical certificate that either baby / mother needs more time off). They infact will deny it. Use it as your grounds to resign the job. Even if he case goes to court, they will lose.

Sorry, I do not have an answer for your question, but what Kishore_I has said, may help you.
 
Thanks guys for the valuable information. I enquired about the short term disability leave, but she is not eligible for that since she has less than one year experience with the current employer. Now we have to search for some other options. I would appreciate if any of you can give me the ref of a good lawyer, who will be able to suggest the best options and point out the troubles we will be facing if we break the contract. Basically what I am looking for is some initial consulting time with the lawyer, so that we can show him/her the contract and get an opinion, and go forward with that.

Call your local bar association. They can provide you with 3 attorney in your area, obviously who does not have any pending complaints. They may not suggest you whom to use.

I would still suggest you to handle it by yourself, instead of involving lawyers. It may get just complicated.

Can you talk to your doctor and see, if they can write a letter for you that your spouse needs extended leave ?.
