Hi Gurus,
I am on H1B and my wife on H4 and both of us are having EADs. Now we applied for 7th year ext and after we filed my wife got a job using EAD. Can she work now?.

If so, what will happen after we get our H1B/H4 ext approved. Is this illegal?. please help

--- YOU applied for 7th year H1B status not “we” you might have sent your wife I-539 form for her H4 extension with your H1 extension. If your wife has valid EAD she can work on EAD till validity date of EAD Once she uses EAD she will have to use AP for re-entry to US. also AP for her if she wants to go out of US in near future as AP is taking 4-5 months in service centers to get it approved.

---- Once you get your 7th year H1b approval extension you will be on H1 status if YOU don’t use EAD, spouse will be on AOS pending and NOT on H4 status as she used EAD. If spouse used EAD no effect on your H1B status you can be still on H1B status. If you the primary applicant or H1B holder use EAD then also the spouse is not on H4 status as H4 is linked to H1b. she will be on AOS pending status if uses EAD and nothing illegal in it.
