Due to financial difficulties, I may need to explore the option of filing the extention of H1B1 without using an attorney. It is really unfortunate if it would happen, but I would like to see how is this option seems realistic.

Please share your experience with me if any one of you have filed H1B1 extention without an attorney.

Thanks in advance.

I think there is a site giving info for do it yourself H1. Check the BCIS site and DOL site.

If you have previous H1b filing complete petition copy thenI-129 it will be much easier to do it, just fill up looking at it, because for the extension your job skill, employer and employer Tax ID remains the same, you have to update only the current employees or current financial status of company.
Your Employer has to get new LCA that has to be attached with I-129, go to DOL site down load the LCA forms fill up let the employer sign it and it is Fax back system , employer will get LCA in 3-4 days

attach new cover letter from employer, copy of valid I-94 ( both the sides)and copy of past H1b approval

thanks, jaxen and ginuu

Jaxen.
thanks for your input. I will do that.

Ginnu,
Do you think i need to submit the copy of initial H1 application?
Like you said, I thought this is straight forward enough to do this by myself since any of job qualification or requiremnt has changed.

Anything I need to aware of besides I-94, I797 in terms of associated paper work?

To who has done this process:
There is a place that i need to explain if my employee applied immigrante petition for me ( I"M waiting on my I-140 approved)
How should I explain this part? Should I just simply state when my LCA approved and when I submitted I-140?

Thanks in advance

i have another question for you.
my first LCA for I129 was done with other wages information.
becuase SESA came up with higher wages that my company was able to pay.
I still saved the prevailing wages infomration and now I am getting paid more, should I update the prevailing wage request and use it? or still with the other wage sources?
just let me know what do you think.

I have a feeling that using SESA source would be the best, but never know....
thanks

Ginnu,

--- No, I wrote that you can see from it what the lawyer wrote in cover latter
Like you said, I thought this is straight forward enough to do this by myself since any of job qualification or requirement has changed.

-- That is why I told you to look at the past H1B filing package that includes cover letter, I-129+ LCA once you read it you will know (that may be with the lawyer or HR)
To who has done this process:
There is a place that I need to explain if my employee applied immigrant petition for me ( I"M waiting on my I-140 approved)
--- You have to write YES, because employer filed I-140 for you
How should I explain this part? Should I just simply state when my LCA approved and when I submitted I-140?
---I-140 is the immigration petition, just write I-140 or Immigration petition filed by employer XYZ
--LCA you attach with H1B and LC is labor certification for your GC that is first approved by SESA then by federal ,don’t mix LCA and LC, LC is attached when your employer filed for I-140

I have another question for you.

--- Better get the new prevailing wages from SESA, it will be more recent

Just let me know what do you think.

I have a feeling that using SESA source would be the best, but never know....
---- SESA source would be the best and it changes every year and depends on your location, on LCA the wages should be according to prevailing wages in your area

Thanks a bunch!

Ginnu
Thank you so much for your post.
I will go request the prevailing wages from SESA and go from there.
Yes, all necessary information I could locate from the initial I 129 and I don't think it is going to be a problem.
I think I will be using on-line LCA form since it is quicker.
So far, Nebraska is processing the I-129 within 3 months and my goal is to submit my applications within this month.

if you don't mind to answer another question for me, it'll be great.

I requested the prevailing wage to SWA, and found out that my employer is paying me 98% of the prevailing wages that SWA replied.

Is this safe enough? or should I use another wage survey?

Thanks in advance
