Hi,
My situation as follows:

Current Employer :
----------------------
I am working for my current employer since 06/2003 and my labor was filed in 2003 and got approved in May/2007.I have NOT filed I-140 and I-485 thru my
current employer yet.
Labor Filed : June/2003 (EB3)
Labor Approved : May/2007 (Not sure of exact date.Employer did not tell)
I-140 : Not filed
I-485 : Not Filed

Future Employer :
-------------------
I filed I-140 using labor substitution through FUTURE employer last year.It got approved in March of this year.I filed I-485 based on the basis of approved I-140 for FUTURE employer in MAY/2007. Got EAD in June/2007

I-140 [Labor Substitution] filed : Dec/2006 (EB2 witth priority date of May/2001)
I-140 Approved (Labor Substitution) : March/2007
I-485 : May/2007
EAD : Received in June/2007

I am still working for my current employer.

My questions are :
-----------------------
1. Since , I have the EAD thru FUTURE employer, should i switch to FUTURE employer right away ?
OR
2. To have one more layer of safety in GC journey, file I-140 thru the CURRENT employer and get the H1-B extension for 9th Year (came to US in 2000) and keep working for the CURRENT employer until green card comes and then join the FUTURE employer ?

Please help !

Thanks,

The choice is really yours to make. Since you have an EAD, you can work for any employer of your own choosing. Your H1-B simply goes inactive.

Hi,

I am unable to make a choice.Thats why I posted on this forum !
I like to know what you all think i should do.

Thanks Again !

Your question is already answered in aother sub-topic posted by you, and linked here.Another post from you from a few days back.
There are a few posts that answer your questions there.
Basically, almost all options are provided.
If you are looking for someone to make a decision for you, that will not happen in this forum, or for that matter, anywhere else.
Even an attorney will not make a decision for you, but will simply provide you with options.
Hopefully, some other folks here will give you some options that you want to hear.

------------------- you can work with future employer now or after I-485 approval (better to work on H1 status and not use EAD if join now) and no need of AC21 as I-140 is approved through future employer and I-485 filed with job offer letter of future employer
Thanks

Hi ginnu,

Another question based on your note above :

"
i dont think that I need AC21 to join the future
employer as I am not joining any other employer,
but considering to join the employer who has filled I-140 based on which
I-485 is filed
"
Please let know , if above is true .

Thanks

Thanks

you dont need to invoke AC21 as your I-140 is approved through future employer and I-485 filed by you is having job offer letter of your future employer. you can join with EAD or with H1 transfer
