Dear all,

please read the following.

http://www.uscis.gov/files/article/11arrestedmultivisafraud02feb09.pdf

Actually one of the arrested is my H1b visa holder company president. This guy has two consulting companies and he is arrested for the other company. He is not involved in the company which is holding my H1b. We are very much worried now as what to do next? I am the H1b holder and my husband is on H4 visa. My questions are

1. Shall we continue with the current company as the current company is paying us regularly and we are very happy with the current company.
2. Is it advisable to switch to another consultant company looking at the involvement of my company's president in the scam (though not my company)?
3. Is H1 transfer becoming very difficult looking at the current down economy??

Thank you very much in advance. We are in lot of stress now a days after reading this nasty news online.

If you satisfy all the H1 requirement(jobs, qualification, wage) and your company is abiding the law, I don't think it will be a problem to you, but may be starting to look around just in case may not be bad idea.

thank you gotPR. I am satisfying all the requirements for being in H1 and so far to my knowledge my company is also abiding with the law. But as such company president is arrested in charge of scam in other company, I am worried.

I will start looking for some other company but you all know these desi companies in NJ/NY. whom to trust? especially in this bad financial market.

thank you again for your valuable input.

i think you are on the Edge. this guys (arrested) will be scruitinised thoroughly by DOJ in the court proceedings. and they will notice his other coy. it is only matter of time, that they start looking into his involvement into that coy activities. so if you want to play safe, move out of this guy's coy.

dear desi2007,

Thank you very much for valuable suggestion. You are right. It will be just a matter of few months (if not days) these companies will be in big trouble. We must think two step ahead and act accordingly.

Do you think being on H1b of this particular company (which is involved in fraud) can affect my status on H1 as well? I am US master's holder with each and every authentic documents provided before filing for H1.

thanks again

i know what you are thinking. this is not about you. No one knows what will be the findings. Her could have made fraud on the income side/on the job spec side or would have cheated tax codes. It could be anything and unfortunately due to H1b laws you will be the ultimate victim. this is what we talk of fairness. I got some news that there are many more investigations going on and many companies are going under. so do all the research on the new coy before you proceed witht he transfer. this looks like a bad time for companies and employees here. May be Obama will be too late to help people.
