Here is my situation.
My I-94 expired in Sept 2009.
I had applied for my H1 extension in September 2009, got a RFE in December, got a denial in Feb, 2010.(as my client didn't gave me the letter). So, re-applied with premium processing. Got my new I797 till Sept 2012, but the extension of stay was denied.
In the notice of decission it states that I am out of status since Sept 2009.
Also, my visa stamping on the passport has expired long time back (Dec 2007).
Here are my questions:
1) What are my options?
I got a few opinions that, I can go to CBP office first rather then going to India for stamping. I am in Chicago btw.
2) If I go to CBP, will that resolve my problem and will they give me the new I-94? (Do we need to call and take an appointment? Didn't really found a appropriate number regarding this, but have the genreal CBP phone number.) What documents you need to carry to go to CBP?
3) Even if I get the I-94 at the CBP office does this solve all my problem completely?
Appreciate if you can shed some light or share your expereince in this regard.
