Please help understanding my Status

Hi All,

A friend of mine who filed I-485 after me just got his GC while i don't. I got Asylum approval in Apr/2002. When i checked my on-line status at USCIS, i saw the message below. What is that mean? Do i have to wait longer and how long? I am confused. Please let me know what you suggest me to do.

Thanks a lot!

Current Status: Response to request for evidence received, and case processing has resumed.

On February 24, 2006, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our NEBRASKA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

That means you are waiting to get the decision from USCIS. I also have the same message although mine says on "Feb 16..." That means your file is complete. You are just waiting for an IO to get a hold of your file. Can you ad your timeline on your signature?

MGTgrl,

Thanks much. That helps a lot. So what does the 60 day written decision meant? I didn't heard from them after i submit my medical results. One more question, to check the processing time table of USCIS, which day i have to use? Is it not the day of my I-485 application?

Thanks again and take care.

Here is my time line:

Ayslum grant: Apr/2002
I-485 application: Feb/2005
FP(code 1): Aug/2005
FP(code 2): Oct/2005
Medical: Feb/2006
GC: Waiting

Match it with the date of the "receipt" USCIS sent you when you file your I-485 in 2005.

Both service centers are still in the 2003's early 2004's...

Hey Jone,

The 60 days means really nothing. I think in their mind, they think they will send you their decisions within 60 days, but it never happens. That 60 days comment gave me a reason to call them and make an infopass about my case, but nothing happened and nothing changed. They basically told me to wait. Now, I am hoping that they will approve me before my medical and fingerprints expire (February). But I see that your fingerprint has expired already so I don't know what will happen!

Thanks all for the valuable info. You are great.

MGTgrl,

I was comparing some people time line and found it quite different and confusing. I also called USCIS today thinking to get a better explanation about the "60 day written decision" but the opprator doesn't know much than what is post in my first message. As to the validity of medical report, i think they already adjusted the rule. It can be valid till your status being checked. Please see the link below.

Good luck to you. Please keep on updating me.

Take care.

Hi Jone,

Thanks for the link. Unless they did another memo like that, the one you sent me says it's only valid until Jan 2004. I am sure they are not going to ask us to redo it but I was just sharing information I got from the IO I talked to at my Infopass. I told her I was worried that my medical exam will expire soon, and she said no to worry because "they will ask you again if your case is not approved by then". But although she said that I don't they will ask us again because it won't help anything except create more backlog and more paperwork.

Hi MGTgrl,

Thanks again for enlighten me with so much information. I am sorry in my part for sending you an outdated memo. I should have realized the date. Anyway, This process seemed more complex than i original thought. You keep on mentioning "Infopass". What is that exactly mean? Does it cost money? I would like to use it if it is a kind of procedure that helps you to find more about the case status. Please let me know. I am thinking to call back USCIS again tomorrow.

Take care!

Hi Jone,

Infopass is actually an appointment you can schedule online to talk to an IO about your case. Go to http://infopass.uscis.gov/index.php. After you fill in the info on the site, it will give you appointments that are available and you can pick the day and time. If nothing comes up (date and time) it means there are no available appointments for the month. You have to wait and try again another time. Let me know if you need help. Good luck.

MGTgrl,

Thanks again. I just fixed an appointment for Friday. I will let you know the outcome. Good day!

I hate to say this, but looks like you ended up with a bad Imm. Officer or your case is in limbo. This could happen if the person working on your case got transfered... Trust me I've see this happen.

I say this because when I got my RFE in 2003, I responded and got the same message as you all. However, my case was approved within the 60 days - in 30 days actually. And, all of us around that time - many of which are no longer contributing to this forum - got approved within the 60 days of sending in the RFE. You wouldn't have gotten an RFE if your background check, security check, and name check hadn't cleared.

I say you keep bugging them. Write to the Center Director in Nebraska - his address should be on the RFE document you got. (I hope you made a copy.) Also, keeping calling the center and keep getting an InfoPass every other month. Oh, you might consider writting your congressman or senator as well for assistance.

I wrote to my congressman a few weeks ago, regarding this same issue "60 days..., bio and medicals expiring" and CIS responded my congressman office within a few days stating that "they are processing 2003's and 2004's.. and my case still waiting to be approved... in other words to wait and keep checkin the processing dates...for an estimated approval...
There was no update in my file in this process...

So wha else can I say... i guess we will have to wait.. and hope tht one of our cases be approved... some day...

That sounds pretty interesting. Seems like I was extremely unlucky and my case got stuck with a particularly lazy moron because there was no movement on it for over four months after my RFE was received - until I starting contacting whomever possible - Congressman, Ombudsman, writing letters etc. At that point I knew that I would be dragged though the nunc pro tunc crap, which means another major headache and many month's delay. I started seeing some progress only after I prepared to file WOM (I meant it and I was completely prepared) and informed them about my intention.
I always wondered about the numbers you have on your signature. Can you tell us what your timeline is and where you are on the process right now?

Hey Morning,

I believe that. USCIS is being hammered with lawsuits so they try to finish up the case before the court date. In fact, this is one of the reasons why for citizenship applications - interviews are no longer held until after the name check/background checks have cleared. They got tired of getting sued by people who got stuck in name checks after their interview.

Regards.

Hey Guys,

I traveled for more than 2 hours hoping to get something out of the infopass. But i really didn't get any thing new that i don't know. The IO told me to call to Navada office for further info. I think we don't have that much to do than "wait and see". It is like seating in the dark. i wish the office has some kind of mechanism where we know exactly at what stage our case is. But for now... the offices seemed allergic to people asking about their cases. May be they are getting thousands of those request a day.

Hi Jone,

Did the IO at least tell you that your background checks were cleared or not?

Hi MGTgrl,

He doesn't specfically told me about my background check rather he told me that my files are right in order but simply waiting for the right time to be processed. As to the medical, i might or might not take the exam again. But i am not sure under what conditions those options apply.
