Please help - travelled on AP, want to extend H1-B

Filed for I140/485 concurrent.
140 and EAD approved
Travelled recently and re-entered using AP.

H1-B (first three years) expiring in 3 months.

Is it possible to extend the H1-B now ? I was told that since the I-94 has been marked as AOS, it is not possible to extend my H1-B.
 
By using the AP you are not invalidating your H1 status if you are working with the same employer.

Using EAD invalidates your H1.

You can apply for H1 Renewal. Normally employers do not prefer to apply for H1 renewal as it is costly and time consuming especially if you have a alternative (EAD).

I've a question:

The links you have provided talk about the interim rule and it states with the condition "until the rule is published". Has this been published ? Do we have to refer to any other document ?
