Please Help to bring my parents from India to US

Thank you so much for reading my post. Well I am a naturalized USC and my wife is a born USC. I got my Permanent Residency through marriage. Me and my wife would like to start the process of bringing my parents from India to the US to live with us permanently. I do understand that the first process is to file the I-130 for my parents and get it approved. Once approved I have to file the Affidavit of Support. Now here is the problem. I have been unemployed for the past 2 years (with no fulltime job) and my wife has been working for the same company for the last 10 years (she makes 60K a year and we have no kids). My parents tried to come to the US and applied for a tourist visa in 2003 and 2006 but were denied both the times. ( no reason given I am guessing they could not establish strong ties to India and in fact in 2006 the consulate officer told my mom to apply for a green card once I become a USC)
So here are my questions:
1) Can my wife file Affidavit of Support on behalf of me even though they are my parents? 2)Also, which form for the affidavit is appropriate? is it the I-864? and does she need to complete the I-864a?Or is it the I-134?
3) We plan to file in Jan 2012. How much time would it take for them for this whole process for them to come to the US? (they live in Mumbai, India)
4) Besides the 60K can we also show credit card limits, car valuation, our house, and most importantly my parents assets in Mumbai as they do have 2 properties in Mumbai of great value?
5) I am applying for jobs everyday so hopefully I will have luck soon but at the same time if I do not have a job when they go for their interview at the consulate in Mumbai would that be grounds from rejection even though we meet the poverty guidelines?
6) Can anyone please put a link to a step by step guide for consular processing?
7) Do I need a lawyer to file all this paperwork?
8)How much time does an I-130 take to be approved? We live in PA. And how much time gap is there between that approval and the request for the affidavit of support from the NVC?

Approximately 2 to 6 months to complete the process from the USCIS I-130 filing, NVC processing and CP processing.

No worries, as long as your income and that of your wife is enough. For a family of four (you, wife and parents) $32,137.

No.

Approximately 2 to 3 months.

Once USCIS approves the I-130, it is sent to the NVC for processing. This time is only a few weeks by the time you receive a letter from NVC to establish contact. You can request to your parents to elect you as the Agent of Choice to receive emails, etc regarding your case and to pay the fees and submit AOS.

Once you have paid the Visa Fees and AOS Fee, you can then send you AOS. It will take two days for your receipt to show PAID. Then your parents can submit their DS-230s with their Civil Documents. Your parents should schedule their Medicals once they have their Interview notice.

For example: I recently petitioned my stepson and it took 70 days for USCIS to process the I-130; three weeks span before receiving NVC letter to establish contact, select Choice of Agent. Another week to receive the NVC Fee Invoice. Once the fees were paid and AOS submitted, then DS-230 received from son, three weeks for the NVC to complete the review process and schedule the Consular Interview for five weeks later. He immigrated two weeks later after receiving his Immigrant Visa in his passport from New Delhi.

Hello Ajay.
You file first I 130, It will take 3-4mts for the approval. Once you file I 130 after 1mounth, tell your parents to apply for PCC (Police Clearence Certificate). There is a form 2, tell them to go to the travel agent in India, take some address proof, rashen card, Pan card etc,and 2 passport pictures. Tell the agent to send the passport of your parents to passport office for a PCC. IT will take 1-2mts for the passport office to issue the PCC. I paid the travel agent RS 1500.00

yes your wife can file I864A, $60K is good. You need not attach any more income. Just 3yrs tax transcripts. Current employment letter and 4mts resent pay stubs. collect all this after I130 gets approved, To collect all this tax documents should not take more that 3-4days.

Once your I 130 gets approved your case will be transferd to NVC and it will appear on line in 2-4 days and you can pay the AOS fee online and once the fee gets accepted you need to print the reciept and send in the I 864 A aPayment long with the payment receipt.

If you are on top of every thing, the entire process should be done in 6-7mts. Thats how long it took for my parents.

start the process first. Make sure they have the birth certificate, and marriage certificate.(Your Parents)

Don't overlook the basic fact that as IRs (Immediate Relatives of a USC) EACH parent is handled individually as far as forms are concerned. ONE form for EACH parent. 2 I-130s, 2 I-864s, 2 I-864As, 2 fees, etc... However, they can be bundled together for processing.

From the questions asked, I got the impression that you need to do your homework on this stuff. It is not simple but it is not impossible either.

I am just very scared that the US consulate might tell my parents that " well your son is unemployed how the hell will he take care of you guys when he is unemployed? yes we know his wife has a job and makes $60K but she is not your son but daughter-in law. We really have a straight forward case in every respect except that I am unemployed and I really don't want to put my parents through the aggravation at their age. I really want this case to be a smooth sail. If I get a job tomorrow all these problems would go away and I am all clear. Worst to worst I am even ready to work in Mc Donald's for the sake of my parents and their interview. But after reading your and few other guys encouraging posts looks like my wife's income is enough.

On other question since I am the only son and if my parents live with me in the US we would like to sell all our assets and properties in Mumbai and bring that cash to the US. Any idea how or where do we start the process? Basically how to convert rupees in $US Dollars? Which bank and how do you transfer that? also any easy ways or ideas to sell all my parents stuff (e.g.: TV's, Fridge, furniture etc etc) the fastest way. It is so easy here in US you know eBay, yard sales stuff like that.

Big Bull99- Thanks so much for your info! Very helpful and thanks for the heads up on the PCC! Also any other insights or information you have would be useful! Especially in the financial area (converting and bringing funds to US, fees we may face, what to expect) and also selling off other assets in Mumbai (best ways, most effective, most lucrative)

As the I-130 petitioner, you must file the I-864. You can get any other citizen or LPR who is: legally competent to sign a contract and willing and able to become a joint sponsor or co-sponsor. This is detailed in the form instructions.

MANY I-130 filers have zero income and rely on a spouse or someone else's help and income. It is VERY common practice.

Ajay, answer all questions truthfully. If unemployed, it is fine. Your wife is co-sponsor. You complete I-864, one for each parent. Your wife completes I-864A, one for each parent. As long as the income equals or exceeds the I-864P, it is ok as you said income is $60K.

On other question since I am the only son and if my parents live with me in the US we would like to sell all our assets and properties in Mumbai and bring that cash to the US. I have no idea regarding how to liquidate your parents' assets in India. I have never been there. Have them consult an attorney and or an accountant there.

I agree, selling on eBay here in the USA is a great way to sell unwanted stuff. (When I retired four years ago, I was a PowerSeller seller on eBay for three years.)
