please help-substituted labor, PD current, single guy

Just got email notice that my I-140 is cleared. You guys shld get yours soon. Looks like things are moving fast these days. They are not being prejudiced against labor subs, so thats good news.

Congratulations doesitmatter! How long does it take for you I-140? 1 month? My lawyser is so slow they have not submitted my application yet :(
 
Thanks guys! Yes, submitted 4/3, approved 5/3. Filed at NSC...transferred to TSC on 4/7, LUD 4/11.

mvcl: Yes, it is very important to get it in soon because of the rules. Dont wait to get 485 docs ready, if your PD is current. Yeah, somtimes lawyers take more time, but it is also important to be sure that everything is in place. If not, they may cause RFE etc...which will delay things even more.
 
doesitmatter, thanks a lot for your tip, I am not sending I-485 now as it might delay my I-140, I will ask lawyer to prepare application as complete as possible.

Just got my I140 approved from NSC on 07/20/06.

Remember I filed concurrently so got ead, advance parole, and finger printing done. What about you ?

I sent in my 485 this week. Will hjopefully get the EAD, AP and FP done in the next 2 months. In time for Oct when EB2 visas will again be available...

Yeah EAD,AP and FP is getting processed pretty fast. Its sad that EB2 India is retrogressed, waiting for OCT bulletin
 
Concern on using EAD?

I have also applied for I-140 and I-485 concurrently. My I-140 is pending.
Just received the FP notice and EADs.
I have few concerns:
1) I-140 was revoked on the previous LC and don't know the status of the other candidate. Will my I-485 face problems?
2) Can my wife (on H4) start using the EAD? Is it better to stick to H4 or is it ok for her to start using her EAD?

Hi Doesitmatter,

I did read some of your post and its pretty unfortunate situation for you. It seems that even I have few things going on with my orgnization. Let me explain:

I work for employer B who was bought by employer A by having more than 50% stake in company B. Then employer A filed my GC as a future employer. Although my H1 is held by employer B, who still runs as a separate subsidiary. Now employer A sold off company B to C. What happens to my GC with I-140 approved and 485 pending for more than 3 months ? Any Clue ? Does C take over my GC process ?

Oh man this is getting even more trickier than mine. Well...not sure man. From what I have read...unless your I-140 is revoked or they ask for employment verification you can just keep quiet.

Since you are still with same company, I think no one is going to revoke your I-140. The silver lining for you is that after Aug1... you will be in retrogression so no one is likely to look at your file until Oct1...which will get you closer to 6 months.

I dont know which company you work for...but if it is a reasonably sized company with lot of immigrants they do take good care of these things. Has your name check cleared? Some people seem to be getting this info by calling? If your NC is cleared...you can just wait...hopefully by Oct you may get it.

Regarding my case..I am not too worried. I think this lay off scare/Aug retro actually forced me to file my 485....I was beggining to get nowhere...nothing on the marriage front, work front and GC front. Atleast now somethings are in motion now and it may all work out for the good in the end. I have reasonable confidence that I will survive the immediate scare...so we will see.

:) Yeah I was just about to feel a little happy with I-140 approval and I heard this news. Both employer A and B are pretty big so no issues on those front, but it seems I would not be able to join employer A. If they ask for EVL, thats the time I am worried about. If they ask for EVL after 180 days I can use AC21(not sure). Attorney is discussing stuff with employer will keep you posted. Hey how can you make sure that your name check is cleared ? I hope the september bulletin opens up some more visa numbers.

I think you took a wise decision by filing I485. You never know when the law would change, once you cross 180 days, you are reasonably safe.

Remember me???? I was looking up forums & saw that you got your 485 approved . Congratulations!!!
I am still waiting on mine since Apr'06. In the meantime, I used AC21 & changed jobs. What all things (write to Congressman??) did you do in the process of 485 getting approved? I would really appreciate if you could let me know in detail about the procedure that you followed.

I-140 and 1-485 was filed in 25th July '07 and it’s in pending status, i did get my EAD. I am getting married next month and will bring my husband in H4. i spoke with my lawyer and she told me that as the PD is not current so won't be able to file his EAD, she also mention as my I-485 is already in processing if my I-485 gets approved before PD becomes current i won't be able to add his name at all. What are the chances of getting I-485 approved before PD becomes current? Can he change his status from H-4 to F1 or H-4 to H1B easily?

To change to H1B he has to send in his application by April 1, 2008 and get lucky in the H1B lottery. H4 is impossible since you will be in GC status, and no longer H1B. F1 is also impossible since he will be married to a GC holder (no longer a non-immigrant). You have basically two options:

1. Don't get married. He can come on H1B or F1. You can get married once the PD become current, and he can file for his own GC separately. But you can't add him to your application (too late at that point).

2. Withdraw your I-485. You will lose your EAD, but if you are on H1B that doesn't matter that much. You can keep working on H1B, and you can renew it by 3 years indefinitely since you will have an approved I-140 and PD is not current. Once PD is current you can get married and file I-485s for both of you.
