Please help : second H4 visa after divorce

Hello,
I am Arvinda Rao, I am working on H1B visa in USA.
Below is my question:

I went to Mumbai consulate for H1B visa interview
and came to USA on h1b in the year 2003. After few
months I came back to india and got married and my
wife appeared at Mumbai consulate and got H4 visa.
After that both of us came to USA and then after few
months in USA my wife and my self had to take divorce in the USA
and my wife returned to India.

Now. I am again in India and got married in India again with other
girl, my new wife is appearing for H4 interview in Mumbai usa consulate,
My question is that:

- Does my wife needs to carry my previous divorce
decree with her for H4 visa interview ?

- Can she get H4 visa on the basis of my H1B visa as my ex wife already
got H4 on the basis of my H1B in 2003 ?

So, in short , I got married again in india and my new wife is appearing
for H4 interview and I am already divorced from the girl who got H4 previously.
- Will my new wife face any difficulties in obtaining H4 visa at Delhi USA
consulate or Mumbai USA consulate ?

- during the H4 visa interview, will she be asked anything related with
my divorce ?


- Is my new wife's H4 case is treated as fresh H4 without being associated
with previous H4 of my ex wife ?


I would really and greatly appreciate your answers to my above question.
Please provide me with your guidance related with my situation.

crazy but there is a long story about that and I have to preserve
my new marriage.)

If she appears in Delhi or Mumbai consulate
with all the required documents for H4 visa , is the
interview officer going to know by anyway that my ex wife
had obtained H4 visa on the basis of my H1 visa in past
and just because of that he will know that my new wife's name is
different then on their computer database for H4 ?
I mean do they maintain the record of H1-H4 association or
H4 is independent visa that they give without looking into
H1 person's record history on their system ?

my ex wife got her H4 in Mumbai consulate, so if my new
wife goes to Delhi consulate for her H4 stamping - will they
ask her that there was already one H4 on your husband's H1
previously and your name does not match with that ?

Please provide me your guidance.

----------------------------- I am sorry to say that you have cheated to present wife not informing of your past and you also plan to tell lie to US consulate and you don’t deserve answer. What kind of person you are???

-----------------US consulate officer willknow that yourex wife got H4 based on your H1 status and no way to hide it

--------------------They have the record. Go to any US consulate or US embassy they have the record

----------------------YES, they will know and inform her and if she does not inform that you were married in past that will be lie to US consulate and she may not get any kind of visa in future.

I am in a similar situation . However my wife knows about my first divorce . My wife already had been to the interview in early October . Anyone in simiar situation can reach to me at amitmm75@gmail.com and we can share some experience please . Thanks
 
Hi,

This may not be the real problem in your case. But here are a few suggestions.

You may need to prove to the consulate that you are in an ongoing relationship. The following are additional suggested proofs which are usually required by citizens who have married a foreign national and possibly could be applied for non immigrant visas as well:
1) Get affidavits from people who attended the marriage (saying that you were not married so that your wife could enter into the United States)
2) Give them your phone call history and email communication history
3) If you have anything in common with her (like a health insurance which you might have already taken to ensure that she gets coverage the moment she sets foot in the United states or any other proof of any joint holding)

For non-immigrant visas the need to prove that you have gainful employment may take more of a precedence.
