Please help, online gambling and n-400

Hi Everyone,

Thanks for the excellent forum on immigration.

My question is:

I have been playing online poker for about 5 years on and off. I have lost money almost all of the times except for a couple of 1000 in jan of this year that I withdrew into my bank account.

With the UIGEA act, is this considered as illegal gambling and will I be considered as receiving income from gambling.

So do I need to answer YES to the question:
"Have you ever gambled illegally or received income from illegal gambling?"

Will answering YES destroy my chances of bcoming an US citizen?

PS: I have never been charged, arrested or convicted for playing online poker.

It is not clear that online poker is strictly illegal or legal. The US govt has passed laws restricting the banks that hold or transfer the money, but that doesn't necessarily mean it is illegal for the players.

Given the legal gray area, and the fact that you have not been charged or arrested for it, I would write NO.

I agree, also, you mentioned that you withdrew winnings, did you declare them in your tax returns ?
