Please Help NIW Question

I will be joining residency in Philadelphia from June 07 and the hospital will be filing my H1 this month. I have already completed all 3 USMLE steps and have also received a temp license from PA state to start my residency. So I asked my lawyer if I can file a NIW as I already done about yr of research and have a publication with me as second author also second one in works. Lawyer said that I cannot apply for NIW based GC as I do not have a license from PA state. Is that true? Can I apply for NIW on a temp license that PA state has issued me?

You can apply even without PA license. The point here is; Is one paper as second author and only one year in research are enough to qualify you for NIW? Try to make your application strong enough by few other publications in high quality journals, abstracts, societies memberships, recommendations from different institutes ....etc

Before working on current research, I was working for almost 18 months on another research and did receive a recommendation letter also. I do understand that I need to make my application strong and am working for it. But when the lawyer said that I cannot apply on my temp license I was kinda disappointed. Hence wanted to make sure if the option of NIW would be available for me and I should continue to build up credentials for a strong application.

In your case, similar to mine, you will not apply as resident or even physician. Your application will be as researcher, so you do not need the medical license and you can include your temporary license, I did so. I do not know if this tempoary license helped or not. The recommendations I think are very important in addition to publications (one paper as first author at least).

but are these things ( research,publications ) needed to file under NIW even when u r on H1B?

Cant u find job in a MUA while on H1B and file under NIW ,once u agree to be there for 5 yrs?

If you are qualified to NIW you can apply from H, J, F, home country, illegal stay ......etc

Wait ofr a year or two. Then you will be able to argue your potential as physician with a research expertise. Try to get involved in some of the research projects during residency. Don't apply as researcher, it will be very dificult with limited no of publications. Then importance of the publications is reduced.
