Please help: H1 transfer, got RFE, Previous employer revoked H1

Hi ,

I applied for transfer from Company A to Company B in June. I started working for company B in June.

Last week I got a RFE for my H1 transfer. In the meantime, my previous employer has cancelled my H1.

Company B is going to respond to RFE in a few days. My question is:

If my H1 transfer request gets denied, what would be my options at that time? Would I have to leave US immediately or would I be able to file a request without having to quit my job with Company B?

Please help.

Thank you,
Miserable

If B's H1 denied, you do not have any staus to stay in US. You can't even transfer your H1 to Company C or D.

Great Guru Help

GreatGuru,

I have an RFE on a H1b Transfer to Company B. Been Working with Company B for 3 months now. Company B is Consultant and i work with Client.
Since there is a chance of H1bTransfer being denied Can i file for a new H1b with a direct employer?

H1B Transfer - RFE Location

My Company ( Consultant) is based in Los Angeles.
I work with Client in San Diego. Actually been working at site for 10 months now.
The RFE is for location.
ie
Why is employeer working at San Diego and what is he doing?

--------------- I think you were with A and A has office in LA and you were working on H1 with client site San Diego for last 10 months. Your employer A should have LCA for location San Diego. Now your employer B has filed H1 transfer and got RFE, this RFE is not for your new employer it is for your H1 with A and not having LCA for San Diego. you dont know how to post details of past job and new job location or employer and one has to guess your situatin. talk to your lawyer with all the details.

ie
Why is employeer working at San Diego and what is he doing?

More Details

I agree it was not very clear because i had not seen RFE till now.
I hope this clarification helps.
In the Past i was working through A for Client SanDiegoClient.
I moved to Consultant B working for same Client SanDiegoClient.

Consultant B has HQ is Los Angeles and Branch Office in San Diego.

I looked at the RFE and it says that LCA is for San Diego and Company shows petition filed for Los Angeles. The query is basically for us to show Client Location and stuff.

ALSO we sent paystubs for May and June. The RFE says that it appears i stopped working in May. So we will send all paystubs again.

------------may be the mistake of lawyer or employer. employer can have office in LA and needed to file your H1 with LCA of work location SanDiego
The query is basically for us to show Client Location and stuff.
