Please Help!!! -H1 Approved, Original Docs not received

Hello All,

I received a H1 Approval on Sept 23rd 2009 and I still did not receive the Original H1 Documents (I-797, LCA etc). :confused:

When I asked my employer, every time he says the same thing that the Attroney has not received the papers yet. :mad:

Today when I called him again, he said may be the papers have been missed in the mail/ Postal and he said attroney has sent a letter to the USCIS asking for duplicates on last Thusday.

I don't understand..should I believe him or not?
It been 4 months and I have nothing to do, but wait.

Please advise me...what is my next step?

Should I wait untill I receive the papers?
should I take an appointment with USCIS?
should I consult an Immigration Lawyer?

------------ you have posted "I received a H1 Approval on Sept 23rd 2009" if you have got the H1 approval notice that is enough for you. why do you need the copy of LCA??

I am not in US, this is my New H1 and I am in India.
Untill I get my Docs, I cannot go for Stamping and work in US.

It seems that US employer does not have job for you and that is the reason he is not sending you papers for Visa stamping. Don’t leave your job in India as many who come on H1 find difficult to get job at this time.

Your H1 was filed by US employer for work in US. it seems to me that US employer does not have job for you or US employer is finding difficulty to place H1 holders with clients. This is the reason employer is not sending you the H1 papers for H1 visa stamping from US consulate. As I wrote to you at this time it is not easy to find job on H1 in US. Since last year the attitude towards H1 is changed because many Americans are unemployed. First preference goes for American citizens or Green card holders for the jobs. Many came on H1 and could not get job in US and went back to India. Don’t leave your job in India and don’t care if employer sends you papers. Even if employer sends you papers for Visa stamping make sure he has job for you in US. if he calls you to US and did not find job for you then you have to go back to India and again you have to spend time for getting job in India.
Where are you working in India?? State/ city?
