Please help... Does the spouse need to be in US during I485 application

Hello great guru's,

Labour is done, and have applied for 140 last month from Boston. But, want to apply for 485, takeing advantage of the recent law allowing us to apply for 140 and 485 parallely.. But the problem is that spouse who is H4-dependent visa, is outside the contry.

So, the question is ... is she required to be in US when we apply for 485. If so, are there any duration restrictions... like have to be in us for so many days/weeks....

The applicant should have a valid I94 at the time of application for I485. So she has to be in US. Moreover medicals (I693) is also required which an INS approved doctor will give only when after seeing the applicant.

There is no minimum stay requirement.
