before i ask the question, let me give you little of the background;

I am currently on OPT which will expire in september 30th, 2007; I currently holding a master degree.

this past tuesday feb 13th, 2007, i accepted a position. but my job currently on a 3 month probation period which is May, 2007; my employer wont be able to apply for my H1-B until after this period; I know the H1-B for FY2007 is expired; and they start to take application beginning april 1st, 2007 for FY 2008; the FY2008 cap is released on Oct 1st, 2007.

here is my question:
1) if my employer apply H1b for me in May; does the immigration have to wait till the cap release before they start work on application that my employer filed?

2) if my employer file in may how long does it take to get it approval; is there a chance after my OPT expired?

Your OPT expires Sep 30, 2007.

Your employer must apply H1b by April 1, 2007 or Little later in premimum process.

This year H1b quota will get consumed very fast, may be first week of May 2007 and US Graduate quota may be May end.

Thats what expert predict year 2008 quota
