Please Help, Can I use AC21 in my case?

- Close to 180 days after concurrent 140/485 filing.
- Got EAD and AP approved, I-140 still not approved
- Going to loose job, but the company willing to help me to protect my GC,
they will NOT revoke my I-140 and will respond to an RFE if needed.

Can I use AC21 by finding another job in the "same or similar" field and moving to the new company after 180 days?

------ to be eligible to use AC21 your I-140 need to be APPROVED and I-485 pending more than 180 days. your company said that they will not withdraw or revoke I-140 but what you will do if I-140 is denied due to any other reason???? Better join new employer with H1 TRANSFER and dont use EAD till I-140 gets approved

I have only 7 months on H1, and my I-140 approval may take even more than 7 months (file date: Jun 2004).
Is it still a good idea to transfer on H1 rather than EAD in my condition?

Yes you are better of staying on H1 untill I485 is approved unless you have to work on EAD.
You can apply for H1 extension ( 7 th year) that should not be an issue.Transfer your H1 and wait untill your I140 is approved if you want to use AC21(by that time you should pass 180 days of I485 filing)
