There is no new law yet so nobody knows what it will say. The law will probably have some caveats so not to encourage new illegal immigrants so I would not go the overstay route. Overstaying for J1 is a big problem. You will be banned from entering the country for many years. Hope you get the waiver, of not, 2 years is not so bad considering that the ban can be from 3 - 10 years.
