Hi,

I lost my Job.

My current status:
I-140 : Approved in November, 2002
EAD & AP : Approved
I-485 : RD - 01/02/2003

Employer agreed to keep me in payrole till July-01-2003, which will complete the 180 days after 485 receipt date. Based on my understanding, that will make me eligible for AC-21 regulation.

1. Can you please tell me what all documents should i have to collect from the current employer which I may need in future for EAD & AP renewals, AC-21 and or any RFE's.

2. Any other advise/suggestions.

3. I am looking for jobs in Oracle Apps. I would be thank ful to you if you can point to some firms who are hiring. I got 5 years of experience.

-- Copy of approved LC, Copy of approved I-140 and receipts of I-485, EAD, AP

----- Try to get new job in same /similar filed, new employer should pay minimum wages written on your approved LC of past employer and before joining ask new employer if he will give you a letter for permanent job offer (for AC21, you can submit it later when lawyer gets RFE or you can inform any time to BCIS).If possible try to join by H1 transfer if not possible then only use EAD, to be on H1 has many other options, also ask if new employer will file LC in RIR.

I-485 & H1-B Issue

Recently I have recieved labor approval (filed January 2003, Approved June 2003) and I-140 was filed 06/13/03.

I will be filing I-485 shortly. My six year limit on H1-B expires 01/20/04.

Can I extend my H1-B beyond six years? Would I still need H1-B Visa? I heard I-140 is taking more than six months in Nebraska and EAD is being issued only after I-140 gets approved. Do I have to go out of the country?

---- YES, you need the SESA reciept when your LC was filed or Reciept of I-140 filing
Would I still need H1-B Visa?
--- It is up to you if you still want to maintain H1 status, many extend H1 to bring spouse on H4 or wait till they cross 180 days after I-485 pending for 180 days(after the date of I-140 approval).

----- I have read the same for EAD but regarding I-140 approval I read in threads that NSC approves I-140 in 4-5 months
Do I have to go out of the country?
--- What for? If you extend H1 you will get new I-94 attached with your H1 extension approval and Can get H1 visa in your Passport Revalidated in US
