Hello!

I worked for a company "A" till July 2001, during that time my I-140 was filed. Couple of weeks after I quit the company the I-140 was approved.

The Company "B" where I work for now, has filed for my labor certification in December 2001. I have submitted a copy of my approved I-140 to the attorney (I am not sure if they used the priority date or not).

The company "A" is ready to continue my Green Card and File the 485...Now...as far as company "A" is concerned it will provide with all the paper work...

1. Is this legal?
2. Can the company "A", file my case, while I work for company "B"?
3. Am I liable to work for company "A", as I don\'t intend to move to company "A"?
4. Does my wife, who is on F1 status, have to convert into H4 status?

Please advice..

Answers...

1. Yes it is. GC is for a future job.
2. Yes company A can
3. After GC approval you have to work for company A. That is the promise. Discuss with your lawyer(your own not company) about what if situations on company B employment after GC approval vis-a-vis AC21
4. Is she converts to H4, she cannot continue her studies. Instead she can apply for EAD and can continue her studies while on EAD. Once she starts using EAD, she needs to have a valid AP for travel.
