Please advise: follow to join for a child

I desperately need your advice on this - I know there is a sticky thread on this topic but I do not see the info there that concerns my case. I am a GC holder since November 2006. My status was adjusted from that of an asylee. Since I left my country (one of the former Soviet Union countries) in 1998 I have not gone back. My now 10 year old daughter is still residing in my home country. I applied for her asylee relative visa and had it approved in 2002(!) but since that time the case did not move and her documents are stuck in National Visa Center. Since I am a permanent resident now I would like to try to get her here on a follow-to- join basis. My question is: am I eligible to file for her in this category? The restrictions that I see on-line seem to only indicate that those GC holders that got their status as a result of a marriage to the US citizen can not file in FTJ category. This is not my case, but may be there are more restrictions. Also, how long does it take in general from the time of filing to the time of visa issuance in this category? Is the process very complicated? It seems that I am not from a retrogressed country.

Any suggestions would be highly appreciated.

I am sure you can do it but its not specified in the 824 conditions. What you can do is take info pass appointment and ask them and also you can talk to the visa specialist at DC. You can find their number at www.state.gov.
If you are eligible for FTJ then you can file 824 otherwise you have to follow the I-130 route. If you its 824 then you can get your kid within 6 months.

try to also contact a congressman, senator, immigration ombudsman, because it's been a very long time, and it's inhumane to keep a minor child who is eligible for a visa apart from the parents for so long.
