Officially and legally entered in april/2005 according to the 5 years period of time we become allegeable to apply for US citizen ship.

Briefly, I will try to explain our situation, over 2 years we were leaving in state of Illinois, April 2005 up to July of 2007, due to job offer in NYC-New York we moved in New Jersey; both of us get employment in the same company located in NYC, New York.

On the beginning it was offered to both of us temporary 3 months contracts. Normally we accepted, the same company has other branch office in Illinois.

Year ago my wife’s contract was upgraded in to a permanent and my employment status is still the same temporary. Timely maybe 2-3 times monthly (all together 7-10 days per a month) I work for the same company in Illinois sub office but officially I am paid by New York main office.

Our current and official family residence is in NJ ( over 2 years) , since my wife get her permanent employment she take NJ residency, me as I told you above due my temporary employment contract and constant traveling back and forward NY-IL, I keep my previous residency on Illinois with exiting address, in mean while ( electricity, cable TV are on my name like a prove of residency over 3 months in New Jersey) the only problem is my Driver license because of my situation still remain on Illinois, all credit card banks accounts are on NJ address.

2007 (the year when we moved out from IL in NJ month of July) upon advice from our accountant we submit taxes for all three states IL, NY and NJ…after that year 2007 we submit taxes only for NY ( working) and NJ( leaving).

As I am informed NJ and IL have differed district center to submit US citizen ship application forms, my question is: we like a couple, legally over 5 years in USA green cards holders, tax payers, married with one kid born in IL and the other born in NJ, my wife with NJ residency over a year and me with IL residency only by driver license (not current) can we submit the applications on the same place and together. Even some of the bills are on both names on NJ address.

Please advise can we apply and submit aplications together in the same NJ district.

Appreciated
George

Your post is very confusing, but I will try.
#1. You should file where you reside. If you live in NJ, do not consider NY (or even IL) for filing.
#2. Change your DL to NJ. I did not understand why you need IL DL anymore. If you are shuttling between the two states, you could change the DL to where you predominantly live.
#3. You can file together ... which only means sending the 2 applications in 2 sub-envelopes within a big envelope. After that, it is USCIS which determines the pace at which they are processed.

Your wife can file her application based on NJ address straightaway. If you want to file with same address wait till you get your DL changed to NJ. Alternately if you are maintaining IL address you could apply now with that address. Your FP ,Interview and OC will be at Illinois.

Only advantage of applying together is that you may get FP,Interview and OC same day. But no guarantee. Both the applications are processed separately even in the same city.

If your official family address in now in NJ, then apply under NJ. Also, get your DL changed to NJ address to reflect this change. Where you filed taxes in the past has no bearing on your application. The main thing is to have at least 3 moths of residency in NJ.

If you decide to file from two different addresses, please be ready to answer why this is the case and - possibly - if you pay child support. Even though you are together, showing two different addresses is a reason for concern for IO. I would bring printout from your shared checking account that shows money from both paychecks deposited, or other similar that proves your being together financially.

Applicant is not a holder of GC based on marriage. Chances about question on spouse's details or child support being raised in his or her interview is minimal. As long as they meet physical presence and have no issues with law and bear good moral character, they should be fine. Staying separately from spouse for 10-15days a month for job purposes is no negative.

Please see 8 CFR 316.5(b)(4) Residence in Multiple States Your N-400 filing location is determined by where you file your federal income taxes.

I was applying not through marriage and yet got the question, so just saying. In my case it was easy as I live with my family.

Thank you so much, appreciated, to simplify currently my official residency is within NJ, we have sub office in Illinois and monthly 7-10 days I am working in IL, I am paid by NY office, the main reason I keep the DL on IL to be honest is just because of auto insurance which is cheaper than NJ…..as I said all the bills in past 2,5 years are on common name together with my wife residing in NJ up to now... ..today, or I shuld take only Photo ID on NJ how I will approve my residency in NJ ?!?!?

Very bad idea that can cost you dearly later. If you get into an accident , your claim can/will get denied since you're not a resident of IL. Plus, falsely claiming residency for insurance purposes constitutes fraud.
