I am now working for compan A and my current H1 expires on Jan 05. I got an offer from company B and accepted already. Can I ask company B to do the H1 extension directly,
---- yes, company B has to file H1 transfer, they dont have to deal with A
without dealing with company A?
Cause I want to start my job at company B from Jan 05, is there enough time for company B to do the paper work and file the petition?
--- company B lawyer has to get new LCA for you and lawyer of B can get it in 2-3 days, then lawyer has to compleate the H1 petition, it takes maximum 2-3 hours, then employer B has to sign the petition and then lawyer will mail it to USCIS, and your lawyer of B may get the H1 transfer filing reciept in 10-15 days from the date of Filing H1 transfer, once you get the H1 transfer filing reciept from USCIS then you can start working with B, you can count the days and make a guess, or file H1 transfer with premium processing and you will get the results in 15-20 days after the h1 is filed with USCIS
If not, then I have to ask company A to do the H1 extension and then change job after A gets the receipt.
---- if you do the above then transfer H1 AFTER you get H1 extension APPROVED for A
Another question is, is it okay if company B has filed the H1B transfer and extension petition, and company A is doing extension at the same time? I don't want to tell A yet about my job until early December,
------- if you are not intrested in A then why you want to make them waste money for H1 extension??? if you are going with B then let B file H1 transfer ASAP, if you think that B is lazy or B lawyer is lazy to file H1 transfer then file H1 extension with A and once H1 extension of a gets approved( 3-4 months) then transfer with B
since they are asking the documents to do the H1B extension. Thanks very much for any advice you may have.
