Plea for help...

Hi All!

Quick update: I have crossed the 90 day -mark and there is absolutely no sign of my green card. Haven't heard from the consulate?
WHAT DO I DO?

I'm sure you guys have lost interest in my case by now. I'm just waiting and waiting and waiting.

It's close to 8 months now and I have not heard from the US Consulate yet. Nothing. Nada. No communication AT ALL.

I get the same automated reply every single time. Is it time to take action? What should I do NOW?

Please guide me.

You can ask your husband to engage his congressman to turn up the heat on USCIS. Unfortunately I think 8 months is not over and beyond the time frame required to adjudicate a case like yours. There are many cases "cleaner" than yours which took even more time to adjudicate. But honestly I am expecting your husband to be more engaged by starting the "agitation" at his end, from within the USA.

There are many cases "cleaner" than yours which took even more time to adjudicate.

Not for consular processing. For immigrant visa processing it is extremely unusual to have a delay of more than 6 months after the consular interview (unless retrogression kicked in after the interview -- but that doesn't apply here).
 
It is over a year NOW!

You are not a lost cause, not at all! We know you are stressed and want to be with your husband, however do not damage your health by overstressing. Because of the complication of the criminal record, your case will take a little more time. The consensus here however is that you will be fine and ultimately approved.

You did the right thing by getting a lawyer. At this point all you can do is wait and see what their decision is. Ultimately like I said, the consensus here is that you will be approved.

It is well over a year since I was interviewed. Phone calls are in vain, the operator only tells me I'm in admin processing.

I seriously NEED HELP. Please tell me what to do? I hate my life right now!

Congressional Enquiry

Dear Friends,

My husband has been actively following up with the Senator in his area and an active congressional enquiry has been set up. However, they are allowed to follow up only once every 60 days, so they aren't really helping.

He has moved residences to stay with me till this case is sorted.

After sending the VFS a curt message the other day, they have asked me to scan my 221g and send it to them.

I don't know what this means. But what should be my next steps?

And yes, thank you for all your prayers and support. I don't know anybody in this forum, but you guys feel like family.

221(g) are given when a visa is refused. Were you refused by the consular officer and given any piece of paper? I do not see that from your earlier postings.

Section 221(g) of the Immigration and Nationality Act

(g) No visa or other documentation shall be issued to an alien if (1) it appears to the consular officer, from statements in the application, or in the papers submitted therewith, that such alien is ineligible to receive a visa or such other documentation under section 212, or any other provision of law, (2) the application fails to comply with the provisions of this Act, or the regulations issued thereunder, or (3) the consular officer knows or has reason to believe that such alien is ineligible to receive a visa or such other documentation under section 212, or any other provision of law: Provided, That a visa or other documentation may be issued to an alien who is within the purview of section 212(a)(4), if such alien is otherwise entitled to receive a visa or other documentation, upon receipt of notice by the consular officer from the Attorney General of the giving of a bond or undertaking providing indemnity as in the case of aliens admitted under section 213: Provided further, That a visa may be issued to an alien defined in section 101(a)(15)(B) or (F), if such alien is otherwise entitled to receive a visa, upon receipt of a notice by the consular officer from the Attorney General of the giving of a bond with sufficient surety in such sum and containing such conditions as the consular officer shall prescribe, to insure that at the expiration of the time for which such alien has been admitted by the Attorney General, as provided in section 214(a), or upon failure to maintain the status under which he was admitted, or to maintain any status subsequently acquired under section 248 of the Act, such alien will depart from the United States.

The white form had a box ticked where it clearly mentioned that I was not refused the visa, rather my app was sent in for further administrative processing.

hi..i hope your visa got approved. Could you please give some updates on your case? I am almost having the same issue but the difference being I have not gone for my visa stamping yet. So wondering if I should go? I was charged with petty theft but had it dismissed through pretrial diversion.

i still have to hear from the consulate. No approval. No denial. Please please tell me what to do?
My husband and i are so so tired now. What should we do?
