Received reply from Dallas BEC

Hi Guys,

Finally I got the following reply from Dallas BEC. I had sent them two email, for 1st mail they said they have not entered my application into their system. But for the 2nd email, I got the following reply with the new case number.

Dear Requestor:

The purpose of this letter is to acknowledge your request regarding the
status of the above-referenced case.

The new case number is: P-04272-08***

The above-referenced case has been transferred to one of the Division of
Foreign Labor Certification's Backlog Processing Centers. At this time,
we are unable to provide any additional status information on Permanent
Labor Certifications. All Processing Center files are in the process of
being transferred into a new database. Once the data entry process is
completed, a 45-day letter will be issued on all applications and
additional information will be requested from the employer if needed.

Please do not request additional status information for at least 90 days
after responding to the 45-day letter.

Hi! i send them 2 email too but i got replied only one email said my new case number is NOT YET ASSIGNED ! i thought it's only me who got a reply like that.

I even got reply from PA BEC but there is no information from them. Dallas BEC is giving the information properly even though your case is with PA BEC.

They dont know what they are doing "God forgive them for their sins as they don't know what they are doing" :mad:

Don't be panic. My Attorney is able to talk to some one in Dallas BEC last week. As per Attorney, Dallas are starting to adjust cases soon. Philly is behind the Dallas so they will try to catch up.

This is just some news posted on website we do not know, it could be true but it could also be false. Lets wait and see if this news is confirmed by reliable sources.

Next time you talk to someone at the BEC can you ask them if they have any idea when are they going to finish to build the database for all pending cases and if they know if is true what Tomshu read :(

Hello all,
My lawyer just called me and faxed me a copy of my 45-day BEC letter. The letter is dated Feb 17, 2005 and he received it today (Feb 23, 2005). They have requested the following in the corrections list:

Verification of the employer is completed during the initial review of the application. We were unable to verify the employer's existence. In order to continue processing, you must submit a copy of the employer's articles of incorporation, business license, state registration or other official documents that establish the employer applicant as a bona fide business entity.

Failed existance check: Employer's address does not reference back to employer's name.
Failed existance check: Employer's phone number does not reference back to employer's name.


Gurus, please let me know how your attorney responded to the above issue.

My employer is a large well known company with more than 3500+ employees. My lawyer told me that he was at the DOL conference last month and DOL mentioned about some problem with their database and some technical glitch with their application. Hence the failed existence check.

Just updated the tracker with my case details.

Employer verification..

I got exactly the same correction list. I thought it was because my employer's name and address have been changed recently. But the wierd part is my collegue who got the letter recently didn't get this additional correction list. Even if they have DB problems, not sure how this one can happen..

Didn't they finish data entry?? God.........how long will it take to finish it??
If they had outsourced this BEC to India, or hire someone from India or China, it would have been finished long time before.
Probably the workers there just finished their GED and started working...and they will decide fate of people with Phd's and Masters.......... God bless us all and this country

My attorney has just received my 45-day letter from Dallas BEC. The corrections list on the letter indicates that the company needs to send more documentation about its existence. Specifically, the following prelim checks have failed:
1. Failed Existense Check: Employer's address does not reference back to employer's name
2. Failed Existence Check: Employer's phone number does not reference back to employer's name

Does anyone have experience in this scenario about what exact documents should be sent to the BEC? The company is in a fairly good standing and had moved to a different office last year (the phone no. is still the same) - so it is probably just a matter of producing the right documentation. Do I also need to get the original form ETA-750 modified? Any help in this matter is appreciated.

I had a similar case. Here is what I submitted:
1. Failed Existense Check: Employer's address does not reference back to employer's name : For this we sent a copy of our MARYLAND EMPLOYER RETURN OF INCOME TAX WITHHELD form (Form MW506) that contains our Federal Employment Identification Number followed by our Maryland Tax Account Number.

2. Failed Existence Check: Employer's phone number does not reference back to employer's name : For this, we enclosed a copy of our recent telephone bill for that phone number.

All this was sent with a cover letter mentioning that our company was bona-fide and we are into so & so business for last x years. We also sent across a company brochure and a contact no. where they can talk to us if they had any questions.

I suspect not all cases are sent to BEC yet. My friend says his case is still at state level ( New York). If their plan is to get all the boxes from all the state offices, and manually enter all of them into the system. Then send out the 45 days letter, and THEN waitl until the last letter date expired the 45 day deadline before start adjudicate all cases. (sounds like thier plan from reading the link). We are in for a long haul.
 
Outsourcing

If they had outsourced it to India, it would have been done by now and you would have seen only Indians getting their labors approved and people, who had not even filed for labor, getting labor certifications :cool: (kidding)

So Scary!

i'm very scary about my case gonna missing somewhere!
my PD on 4/11/03 and my RD on 9/24/04...(SWA-VA)
i didn't get my LOVE LETTER yet and when i send email to check my case status to Dallas BEC and Philly BEC, they said my new case number is "NOT YET ASSIGNED" <-- what's mean ?
I don't know what i gonna do , so scary, depressed and very...y worry....y :(
Dose anyone has a same situation with me?
Please.....
