Is it too Optimistic?

I talked to my lawyer today and he told me they have received the 45 days letter. Also, this is what he expects to happen:

Labor approved by June-July 2005.
I -140 and 485 approved by the end of this year or early next year.
I-140 and 485 should be approved within a month of each other.
Green card by early next year.

I have not seen him this optimistic before. Usually he hesitates to give any timeline estimate.

You should listen to lawyers but you should never get your hopes high just because lawyer said something. Thats what I think.

got this today. as always, the corrections list includes Failed Existence Check of Employer's address, phone number bla, bla........ even if we have been the same address for more than 20 years.
BTW, anybody gave me a link regarding respond the correction list. I thin i saw that somewhere, but couldn't find that. Thanks.goog luck to everybody.

Ha, so it may not be a big deal for people who got this line in their BEC letter. It looks like a system glitch. I have seen quite a few people in this forum getting this exact message.
 
That's great news.

My case was submitted in Apr. 2002. It's pending in BEC. I've got my letter on 1/31/05. It takes probably a few more months to get the LC certified in BEC so hopefully by then the visa will be available for me.

How many of you are on the same boat? My attorney screwed up when we first put up the ad. telling the HR to put requirement as BA degree with 6 months experience even though I had a master with 5 yrs experience already! So I'm stuck with EB3. :(

In my early days, when I was pretty naive, I had asked my lawyer, on the phone, "So.. when do you think I'll get through this entire process?"
He went "AArrrrrrrrrrrrgh...<pause> OOOwwwwwwww... hmpff...<longer pause> Owwwwwwwwwwwwww.. hmffph.. <snort> hmffpf"

I never asked him again... :D

I agree your lawyer screwed up...I also feel that he probably did that to be on the conservative side in order to avoid queries from DOL / SWA in which they could challenge the minimum Master's degree requiremnet for your job using their dictionary of occupational codes and statistics of recommended minimum requirements for various jobs. Good for you that you are just a month away from getting a EB3 visa.

I did a search and found this article about visa retro. It's prediction of visa moving by April was outrun by what actually happened. Hopefully that's a good sign of things finally moving.

We're YET to see here the FIRST case to be certified by BEC.

Question

I keep reading EB2 and EB3 being mentioned on this forum. What difference does it make to folks other than from India or China? Does it take longer to get a green card with EB3 case as opposed to that with EB2 or vice versa?

Guys, any indication that for the folks who received the letters and have replied- that their cases are going to be processed as well? Or are they still going to wait for all letters to come back, make one big list and then start processing?
 
No Love Letter And They Have No Love For Me

I am getting frustrated day by day. Even after waiting 4 years no love letter received. Any one knows what is going on with 2001 cases? :mad:

Yesterday I read in some forum that someone received BEC letter from 2001 PD, so maybe your love is going to meet you on valentine's day.
 
Finally, I got 45 days letter.

Love letter was sent in my office, my lawyer didn't get yet. I faxed it to my lawyer and he responded it.

When do i know result of LC?
One more thing, how can i know BPC get my lawyer's response?

I hope you that didn't get love letter will get it as soon as possible.

OIG report on FLC

For those who are interested the following report makes fascinating (if depressing) reading. It contains the results of an audit conducted by OIG into the effects of Section 245i back in April 2001. This was the root cause of why we are all now in pain with delays and backlog.

Aside from being angry about the effect of these frivolous LC applications the reccomendations to do some of the employer validity checks that we have been seeing in the BEC 45 day letters was a firm reccomendation at that time. It also explains a little about the key criteria that are used to adjudicate cases which I found intersting.

If nothing else reading this will make you a little wiser about the size and scope of the problem and about the mechanics of how ETA was/is trying to run the show.
