I might be totally off base but .... I think EB2 and EB3 makes a diff.... One of my colleagues EB3 RIR (not on this list) at end of last month had his LC approved from Philly DOL after about 6-7 months DOL received his LC.

ndnori... you mentioned that other applications were also before bharadwaz were pending.... were these EB2 or EB3 applications... Can you verify and let us know

I was randomly che cking in automated system .2-300 nos before my case and 2-300 nos after.That is how I could say that some cases recieved in feb are pending and some recieved even on 21st mar are cerified. the system does not say whether the case is EB2 or EB3.
 
I am getting worried that we have not received the approval notice after two weeks. Is there a way to contact DOL to see what has happened?

I think your lawyer or employer can contact DOL.Why don't you request either of them?
 
I added a column which calculates the number of days elapsed since they received it....it all just adds to the suspense ;)
 
I have a question. In preparation for the next stage of the process I have to decide between 'Consular Processing' and 'Adjustment of Status'. Here are the arguments as I see them;

Consular Processing
Should take about 7 months for the I-140 plus about 3 months to get an appointment at the consulate in London so it wouold all be over in as little as 10 months. The downside is that we will have to go over to London and make a personal appearance. Does anyone know if this is risky? Might they reject us for some reason during the interview, or is that very rare? I was told there is no appeal process if you fail that interview.

Adjustment of Status
Should take between 15-18 months even with concurrent filing. My wife could work after 90 days. 180 days after the I-140 was approved I would be free to change jobs/companies. The downside is that it takes up to 18 months and no one is quite sure how well the concurrent filing works because it is so new.

My gut feel is to go with consular processing because I feel secure in my current role and I'd like to get this all over and done with ASAP!

What do you guys think? What will you be doing.

I was told by one of my friend that with concurrent filing, the ACT21 rule of changing jobs does not apply. It is applicable only if you file separately. Is that true?
 
The lawyer said that the confusion arrises from whether the 180 days is from filling the I-485 or from the approval of the I-140 but that it did apply.

The truth is that that law was written before the concurrent filing and so nobody seems to know the answer!

I have been weighing this too. For AOS, INS officer cannot deny a case unless they find someting clearly in the law that the case should be denied. And you can also appeal the case. But for consular processing, if you are denied immigration visa, then you are stuck in your home country.

At Vermont Service center, I-140 is slow, but I485 usually is not that bad. Concurrent filing takes as long as I485 -- up to 18 months. For Consular processing, it takes I140 + 3 to 4 extra months, up to 16 months.
 
My lawyer said 7/8 months for I-140 - isn't that true?

Any idea how yo know what type of I-140 you have E11, E12, E21...

It a good question regarding appeal when you go to CP. I will work on it to get some information. Even I am thinking to go for CP only. They say if you have all your records like education, experience, tax filing & other papers properly lined up,
then its worth trying it.
 
Consular processing: I came across a case while reading though some time back, one guy got stuck in India because there was a fraud case in his credit history, someone had hacked his credit card and used it, but the credit fraud was resolved. But the consulate suspended his H1 and was asked to stay in India until they completed their investigation. I am not sure what the outcome of the case was. So beware...

Also, just to make it a little interesting, I re-organized the sheet little bit.

I am from England so I believe London is where I would have to visit, (I didn't mean that everyone had to go there ;) )
