I agree with you. But in case of SWA it never happened.
Like they were processing the cases in the order they received.
But here it is completely different story, As we have seen several approvals from Oct, 2003. There was some sync up between the SESA declared date and the approvals.
This is my concern.

I had the opportunity to speak with a certain individual who works for the DOL and is a certifying analyst. This is the information I received.

- After the carlson memo DOL has received directives to use the following guidelines to certify case
- B.S + 3yrs or a M.S + 6month
- enough evidence of adequet recruitment effort
- Wages offered meet or exceed prevailing wage
- Company actually exits in the state of filling and is not just a PO Box

If the above guidelines are met the cerifying officer is to certify the case. If there is issue on the recruitment effort and the wage offered, the employer would be asked to re-advertise for 1 day (this is not a RFE nor a NOF, something in between and something new that the DOL is experimenting with)

He also confirmed that the DOL is aware of the fact that companies are opening PO Box offices in faster states like Delaware and Wisconsin. To this effect the Certifying Officers have been directed to personally go visit the Locations. The individual I spoke with said that he himself has visited many Company locations in Delaware to verify if the company exits there.
This could be a reason for a slow down in the processing times. By the way the individual I spoke with works at the Philly DOL

seems the DOL team is back from their Florida vacations ..
I wonder how come they take these matters so lightly ...

do u think the posting of some tie up with lawyers and DOL employees might be valid ... for rejecting RIR cases to make extra $2000 per case.

need_green_card, Really appreciate if you can reply to the question on NOF. It seems like all DE companies got NOF. Were you also in one of thoes? When did you respond to NOF and how long it took for final decision on NOF.

My NOF reply is pending by Mar 11th, and my company is telling me that there is 50-50 chance of convincing certifying officer on company infrastructure/main branch etc questions. Any insight in to cases from Delaware will help.

Pennsylvania is planning to transition all Foreign Labor Certification (FLC) activity from the Philadelphia FLC Processing Unit to the Harrisburg FLC Processing Unit. The anticipated transition date is April 15, 2004. Until the anticipated transition date continue to submit their H-1B Prevailing Wage Determination Request Forms and Applications for Alien Employment Certification, to the Philadelphia FLC Processing Unit .

As of April 15, 2004, all applications, for counties within what is presently the Philadelphia FLC Processing Unit's jurisdictional area, should be submitted to the Harrisburg FLC Processing Unit for processing. Staff, who were temporarily assigned to the Pennsylvania project last summer that resulted in the elimination of most of the 3,000 case Philadelphia backlog, will be available to assist staff in the Harrisburg Unit to facilitate the transition.

Reduction-in-Recruitment (RIR) applications generally are processed quicker than a regular permanent application, so we encourage the submission of RIR applications whenever possible. Employers are also encouraged to recruit workers by entering their job orders directly into the PA Careerlink on-line system by using the PA CareerLink web site www.PACareerLink.state.pa.us . All the application will get through the system quicker if it is complete and that all appropriate documentation is included.

Beginning on April 15, 2004, FLC applications for jobs located in Bucks, Chester, Delaware, Montgomery and Philadelphia counties should be submitted to the Harrisburg Processing Unit. The Pittsburgh Unit will still be responsible for processing cases from Allegheny, Armstrong, Beaver, Butler, Clarion, Crawford, Erie, Fayette, Forest, Greene, Indiana, Lawrence, Mercer, Venango, Warren, Washington and Westmoreland counties.

As of April 15, 2004, the Commonwealth of Pennsylvania will have two Foreign Labor Certification (FLC) Processing Units to ensure high quality customer service throughout Pennsylvania.

For short term, it might cause some delays too.
It all depends on how much effort involved in moving applications to PA, training if needed, etc.

I am working as a consultant. My employer agreed to apply for my GC in KY. I have given my papers to lawyer. He said he will apply for my labor in few days. I know this employer very well. But my project may end in 1 or 2 months.

I heard I can buy labor certificate if some one has it. I want to go for it. Since my project is uncertain.
Is it required to get one more H1 to apply for I140 & 485 if I get labor clearace form someone?

If you know some one who has labor clearance I am ready to pay.

Please help me in this.

I can tell you, everyone in this forum are much much desparate than you and are in much difficult situations than you. Buying labor is not a LEGAL option. If it's legal, we won't be waiting like suckers here. ;)

If you buy one, then you need join as an employee of seller. And, you are not safe until your get Green Card gets into your hands. I mean, as soon as DOL knows this word and they will start investigation. Then, all of us will be in deep deep trouble.

This forum DOES NOT ENCOURAGE this kind of posts here, though you are free to do so.

My sincere suggestion is, go find another project. It's safer than being outrightly illegal.
 
DE NOF

No NOF was issued for my application, my company has a head office in DE, with development centre and administration staff, good setup and is 10 years old company.
 
It is because of people like this that the majority of labor applicants face increased scrutiny resulting in processing delays for ALL applications.

Hi Kumar, Of course 'buying' immigration status is fraud and illegal. But it is NOT illegal to fill a position where Labor is approved but the original candidate is no more available to fill it. Look for genuine companies looking for right skills to fill position on pre-approved labor. Any company asking $ for pre-approved labor is most probably is not a good one to join.
