H1 To F1/b1 Tourist??

Hi All:

Can a H1B holder (after 6yrs) stay in the country on F1 for a year or
on B1 for 6 months and then apply for a new h1b?

Any other options other than mentioned above if available please adivse.

Note: This is for my friend. Iam elgible for 7th yr extension my self, but my friend has not started his LC and thus wants to find the other options. The emplyer is willing to apply for new H1B.

I don't believe it works that way. Unless their I-485s have been approved, they have to wait in line according to priority date. If your priority date is earlier than theirs, even though you file next year (hopefully), your case will still go before theirs.

For EB2 filed under PERM and approved before end of Sept, I485 can be filed before then even though they probably have to wait for a long time for approval, but AP and EAD can be filed too for those cases.

I wonder where the groupies would go if in Nov bulletin ,the visa availability dates move to 2002-2003.How would you feel, if people who have a PD much later than you are able to avail of it all because we were cooling off our heels in stupid Phili busy bonding.

I completely agree with what you are saying. (I only disagree with your request to transfer the files to DBEC, you just can't tell them "how" to do it, just tell them "what" and "why", and not "how").

I just don't believe there are so many members who registered since 2001, 2002 but hardly they posted 5 message on the board. They don't actively participate in any effort thinking "all these people are doing, why I should do it". But when they have personal questions like (how to convert H1-F1, or whats difference between EB2 EB3, how to convert perm to RIR, rir to perm, fk to fk), they will come here for answers. Stupid, selfish people.

We have 1000s of member reading this messages, but half of us are so selfish not even registering for yahoo group to raise the awareness.

Even if you don't believe awareness don't work, then please suggest how we can solve the problem, instead of coming to the forum every morning, reading messages and forget about it till next morning.

Other problem is, we should support each other who shares belief, that will make idiots realize that you are not going to get much from here without the "community".

Lot of people are so ignorant about whole visa retrogression, they worry more about it than labor. But let me tell you guys, I would be disgusted, if visa dates becomes current today, because if that happens we are the sole loosers. Because when our time comes next year to file for 485, the dates would definitely retrogress back. So please focus on labor, help us in our effort, sign up for yahoo group (PBEC_LABOR_VICTIMS), and help community.

NOF is issued because the employer filed out of PA whereas registered office is in MD. ANybody know if I can file for 7th yr extension when my case is in NOF? Also if I do file will there be chances of denying the extension because of the NOF?My screenshot says case status as NOF?

My employer is working with Sheela Murthy's office to prepare a response to the NOF (34 other cases filed from PA were also given same exact NOF). They seem to pretty confident that they will get approvals but still want to file for me under PERM, but I am hesitant to do that as DOL may come back and deny that too_Of course they will be filing PERM through MD only.

Anybody, know anything about such a case?

I don't believe this statement is true. It is just unfortunate that your case was sent to Philly rather than Dallas.

I'm still hang around. I've no idea what my status is but I only know my PD is 10/2001 which will never change.

I was very active at the beginning of PBEC's initial set-up last year and I was also very opmistic too at that time. But after awhile I felt that all the information received from the PBEC were not true and they change rules every day (or maybe there is no rules at all). I feet we are powerless at all because we have no voting rights and no one is or will take us seriously. Moreover the US retirement SS gap is really dependent on us to fill in as long as we are not taking any benefits from the government and the longer it takes the more the US government will benefit from us.

Status-Final Review

I checked my status again and this time it takes only 10 minutes to get the response: Status-Final Review. I was told by my HR 45 days ago that my case was just sent for final review. I did not check the status again until a couple of weeks ago, but got no response at all. I tried this morning, and it worked this time. My PD is Feb 02.

I would like to request all silent readers of this forum to post their LC case details in the BEC Priority Tracker thread. Our friend JustWatching is doing an incredible job in maintaining the tracker spreadsheet which gives us a wealth of information regarding BEC approval trends.

I also request everyone to make sure your LC case record in the spreadsheet is up-to-date. Also, please post any missing information that you can provide about your case. Clean and complete data will help us get better summaries and reports from the spreadsheet.
