Finally My Labor Got Approved !!

After long wait of 2.5 Yrs, Online status shows my labor is certified.

Thanks to everyone on this forum for direct/indirect support to get thru this mess.

Anyone have idea about expeted wait time to receive papers from PBEC?

My Employer filed two Lc for me the first lc was filed from New York on june 26, 2002 and then the secound lC was filed from Main on March 28, 2006 . although my employer has his corporation registered both in N ew York and Main but the same Tax Id on both the application . Do you guys think it could be one of the reason that they are holding my lc .

My pd is 06/26/2002 my case was assigned to analyst on june 9, 2006 and then it was reassigned to analyst on spetember 29, 2006 . the website status still shows in process status for both of the cases .


Recently the 202 # guy told me that they are no more providing any information over the phone . but he told me that backlog will be eliminated by september 30, 2007 . and all cases weather its RIR or NON RIR will be decided by that date .


Guys please help if you know the answar

Let me know what i can do now. How can i file in PERM working with the same company. Earlier i applied in EB2. Requirement was bachelors degreee with 6 months of experience. I do have masters degree. I have experience only from other company i am working with right now.

Question
1) Can i apply in PERM by working with the same company? or I have to change company in order to be eligible for work experience.

2) Also i have 1 year and 3 months left on complition of H1B. What is the latest time that i have to file in perm. 3 month from today or i can file in 6th year?

any other ways to apply in PERM by working in the same company. Please help.

Sorry to hear about your denial. There are couple of options open to you:

1. File in PERM. It is 100% valid to file in PERM from the same company again. Once your PERM is approved, file I-140 in premium process. You may get approval in a week. This will allow you to file 3 year H1 extension. But this, you need to do it ASAP.

2. Your lawyer can appeal PBEC. This will bring your case in "Appealed" status. This will help you to get one year H1 extension and some breathing period.

My 2 cents.

Did you file the PERM application with the same employer for similar job? In that case, by default (as per the postings in this forum) the BEC case will be withdrawn after the PERM labor is approved. So you can potentially loose the valuable 2002 PD. Now, depending on the country of birth and PD, you should compare the two pending labor applications. PERM labor is better for faster processing, but it results to either approved or denied. Whereas the advantage of the LC pending at the BEC will generate an NOF in case of any issues and of course the earlier PD. Please go through the excerpt below (from immigration law website). You are the best judge - now be pro-active and decide whether to go with the PERM or BEC (in this case withdraw the PERM).

09/23/2006: Consequences of PERM Filing with "Refile" Option on Pending BEC case

The 09/12/2006 Liaison Minute clarified the DOL policy on the issue as follows:
  • PERM database and BEC database are growingly communicating quicker and BEC will almost immediately take out as withdrawn.
  • If BEC case is approved either before the PERM case is adjudicated or BEC takes action taking out such case as withdrawn, such certified BEC application will remain valid. In such cases, employers will be allowed to withdraw the pending PERM application.
  • If BEC case is still pending and such PERM is denied, two consequences will take place. The beneficiary loses the priority date of the BEC case.
  • Additionally, the BEC case is considered automatically withdrawn. Quickly refiling of another PERM application will not change the deadly consequences on both PERM application and BEC application. However, employer can file a motion to reconsider if justifiable. If the motion is granted and certifies the original PERM application, the old priority date will not be affected.

I did not file Prem .both of my LC are pending at PBEC . I received two 45 days letter one with pd of 06/26/2002 eb3 from NY and the secound one for march 28, 2006 EB3 from Main State . job title and duties are same the employer is also same . since my employer has two offices one in NY and the secound one in Main state . I am from Pakistan and my PD is current .

But isn't this true only in case PERM is filed with a "Refile" option? If PERM is not filed with the "Refile" option, do you think it impact the BEC labor app. I am in a similar situation. My case was pending with PBEC uptill yesterday when the status changed to "Withdrawn". I have an approved PERM (filed in March 2006) from CA with a pending I-140. But this PERM was not filed as a "refile".
 
My case is messed up too...yesterday status changed from In Process to withdrawn...The lawyer is looking into it...

11/07/2006: Multiple Labor Certification Filing Alert

There are growing number of reports that the BEC was sending out a "withdrawal" notice to the employer if the same employer filed a PERM application for the same job and the same alien "if" prior old priority date labor certification is pending at the BEC for the same employer for the same employee and for the same job. This withdrawal notice was sent out even if the employer did not request "retention of priority date of previous application" in the PERM application. Should this happen, the consequences will be so fatal and devastating if the BEC case has a very old priority date, the readers are cautioned to take this posting as an important alert. Reportedly this practice of the BECs loomed up only very lately.

How could a case with PD of March 28, 2006 went to BEC? That's why I assumed it to be a PERM case. If you have 2 LC applications pending with BEC, I think, you can just wait till one of them get adjudicated (as your PD is current).

My 2 cents.

In addition to PBECIsKillingMe I would like to add the following:
File the PERM ASAP - if done within 3 months - your future H-1B extensions are secured. If the PERM filing is delayed by a few months after completion of 5th year in H-1B status, file I-140 in premium, so that it gets approved before the completion of 6 years. This will entitle you for another 3-year extension. Otherwise, appeal on the decision - to buy time for another year's extension.

I am sory manwithnoname the secound case was filed on 28 March 2005 not 2006 from Main and its also in PBEC

I passed my 4th year anniversary last month, but it pales in comparison to your situation.

I can imagine what must be going through your mind, hang in there buddy, things will work out.
