Since I am also from Non-retrogress country, I have 5 years of experience and a bachelors degree which I think qualifies me for the EB2 catagory. I talked with my lawyer and he said not to do it as not tranfer to eEb2 as it might be risky.

Tot, I "thought" my old labor was EB3, but in fact it was EB2 all the time, I just didn't know about it.
If you're really qualified for EB2, you should go for it. I don't understand why your lawyer said "not to transfer" ... it would NOT be a labor transfer, you'd be filing a brand new case using PERM.
I think you're having a miscommunication with your lawyer. Just tell him you want a brand new application, using EB2 criteria. If he insists, dump him.
Of course, you gotta make SURE the job/position really requires BS + 5, that's what matters, not whether you have BS + 5. Evidently, if your job/position requires BS +5, then you HAVE to have such qualifications.
