I am not sure what do you mean by "buying pre-approved labor" ? are they selling it on ebay, amazon or something?
Anyways, since you have LC pending with PD of 2002 you can switch jobs and apply for yearly extension, why do you want to wait for 140 to be approved? You will just have to persuade your company to not withdraw your filed labor (most companies continue with the labor to use it for someone else) and you should be fine.
 
I believe that Stephan Stefanko has recoverd from his sober condition and gone to coma again after the holiday.

You cannot apply I-485 till your priority date become current.

You can only apply for I-140. You cannot file both together anymore.

Look at the following case. His labor got approved in one months after he replied his 45 days letter. You may expect the same if your case is RIR. PBEC is not following FIFO order. But the process seems little faster than before.

I don't know about that. I and my collegue has applied together and he got his 45 day letter six month earlier than me. However, we found out that the first six digits of our ETA case number are similar i.e P-05013-xxxxx

Thanks GC_Lover.. My only worries is that my current 9th year h1b ext expires on Nov 2006 and my assignement ends on may 06. My employer won't keep employees once this engagement is over in may 06. so, I need to change employer some time after may 06. I can try to persuade them to retain my labor so that I can apply for h1b extension with new employer.
If I change employer sometime around may 06, I want to know whether new h1 b extension with new employer will be valid upto Nov 2006 or May 2006 eventhough my current h1b expires on Nov 2006 ??.
Does the one year extension will be from the date that we apply or the date the current h1b expiry??

one year from date of current H1b expiration or whenever your 6 year period ends.

I am trying to give you hope. You will get your approval soon.Is your case number still starts with T? Or if it has changed to P. Have you noticed the number in your 45 days letter?

H1B 7 year Extn

A question to the people who have applied for 7th or further year extensions. When I apply for 7th year extension, do they also add the duration during which we were not in US in the first 6 years ? e.g if I have been out of US for Job/vacation for 6 months in 6 year duration, will they give the 7th year exntension for 1.5 years ?

My PD is Aug 2002/RIR/EB3/VA and I am going to celebrate one year Anniversary for my 45 days letter this month but no status of Labor yet :mad:

I haven't yet applied for 7th year, but I'm 100% sure you can recapture those months you were not in the country, I've read about it on this forum ... I believe they don't do it automatically, you have to request it somehow, and there's a way to do it ... do some research here and other immigration websites, you'll find the info.

the quick approvals are happening only for NY, for some reason ... it's clear there are different procedures for different states, or it's the officer who does what he/she wants :(

what does processing type : 'TR ' in the case status reply I got from PBEC..
I sent in an email 2 hrs ago...reply was very spontaneous...I almost cudnt blink my eyes for a while...!!

I know that my application was processed in RIR and not Traditional mode..

Please let me know..is it a general column filled in or does it mean the application as non-RIR..
 
Processing Type TR means Traditional

....... so far I know. Double check with your lawyer. Make sure they are processing your case as RIR. Not TR.

Hei, it happened to me too. I just send the status request to H1B7YR@PHI.DFLC.US and they reply within an hour but the problem is I can't find my case status.
