Have you tried getting a screenshot from the PBEC? If not, maybe you should send one just to know that your application/file is with them and still active. All the CA people i know have received their 45-day letter first half of 2005. Since your PD is 2002 and went to region, you should have had the letter late 04 to early 05.

Thanks! But I requested my lawyer to get a screenshot from the PBEC. My lawyer
said that screenshot is for special purpose only i.e. to get status while applying for
a 7yr extension. I am not sure what to argue over it.

These guys were building the slot m/c in atlantic city. Last yr there was a job recruitment for P Backlog Expand Center.

My PD is older than yours, August 4th. I haven't received my 45 days letter yet. If your case is RIR it shouldn't take long. May be by June you can expect your LC. But traditional cases will take longer. Because PBEC hasn't sent any recruitment instruction yet.


I had applied even before that ( 245i ) and now I'm running two aplications , one with PERM, and the other one with the old system. all this is making me spend big bucks but all I want is a papper in my hand.
I was desperate thats why I restart with perm , also my attorney told me that the "people" in PBEC throw everything in boxes , so they are not going by dates
also some of us are not reciebing 45 days letter but getting LCs approved

But The Prboem Is Some Officers Are Very Active With Other Are Very Lazy So It All Depend On The Officer Who Is Working On Your Case Some Are Getting Rid From The Application Very Quickly . Other Are Just Sitting On It Just For No Reason Thatsway Some People Are Getting Approval Within Two Weeks Of Getting 45 Days Love Letter

If your case is in immigrations You Can Just Go On Line And Get The Status Of Your Application In Few Secound While In Labor Department You Are At The Mercy Of Your Lawyer Your Employer And The Labor Department

There Are 100 Officer Working In Pbec But Still Some People Are Waiting For 2001 Cases

let me tell all of you labor is more painful then immigration stage I-140 & I-I485

Life Is Becoming Very Difficult For Those People Who Dont Have Green Card In This Country

when I want to check my status I just call there and they always tell me a diferent history about how cases are going , but at least they are working
 
Most of the states were processing labor certs in a reasonable time. So, if you filed from Vermont, it was taking only a month to clear your labor and then Boston was not too long. So, some of you talking about not fair this and that. Because of states like New York, Maryland and Virginia, rest of the labor people suffered. Instead of waiting a few months or so, now they have to wait for years.

Anyways, they should've only transfered the states really backlogged and leave the other ones process what they have until they're finished. Everything would have been finished by now. Even, keeping Maryland, etc where they are would have been faster. It took nearly 2 years to just mail, box and file labor files. It does not make any sense. I am sure, somebody paid some government official good bucks to create this new system, so somebody can make some money.

Bottomline, BEC idea does not make any sense. It only passed cause, they did not have PERM when it was drafted. (or thought it would never become a reality) Back then, they were gonna move these old cases to BEC and SWAs were going to process new ones. But then PERM got created and BEC idea did not make any sense. But, I bet someone got some campaign money from these contractor firms. So, they just created BECs. These people are not citizens. They are not gonna raise questions. Hey, it's legal immigration. Who would say anything bad about it. oh well, somebody is making good money on our expense.

I would raise these questions to senators. If, most of the files stayed at SWAs and regionals, with no new files coming, then all of these cases would have been finished by now. Wasted 2 years for boxing and mailing and filing.

So stupid, hard to understand how it passed thru and became a reality and nightmare.

Hi,

I have applied my LC from company A in July 2002 (under EB2/RIR my employer told this). Currently it is in Backlog center. I don't have any proof of evidence that lawyer applied the GC.

I came to know that Lawyer doesn't have any proof from Backlog center or from Labor department except the Application he submitted to labor dept.
( No number to track )

Currently I have only 14 months time for the 6 years completion. And I Planning to apply through PERM from company B as a precautionary in case of any denial (at labor/I140 stage )from company A because only 2-3 employees are working now.

But company B needs any letter of evidence or any kind of letter showing he labor was applied > 365 days.

How can I produce this to get my H1 7 th year extention.

Company B is telling me that - For New PERM process even to apply it is taking at least 100 days (advertisement and all other..)

Please suggest what to do......

Totally agree and you are not alone. I have poured tons of money into those attorney's pockets for RIR, PERM, and H1B and H4 extensions plus Ads running on newspaper, internet....this and that. I guess I can buy a new car already if I use all the money I spent on immigration. And, I know, I am not alone. No matter which LC approval comes out first (RIR from PBEC or PERM), I will just use it to file the I-140 and I-485 right away. I am sick and tired of this LC system already.

My PD is Nov.2002 ( RIR -EB3 ) from CA
My lawyer replied to 45-day letter in March.2005.

Advise Pls

My labor RIR ,EB2, PD 05/17/2002 MD is still pending and I have 5 months time for my current assignement ending in May 06,2006. In order to escape, my labor has to be approved and I should get my 1-140 approved so that I can change company OR I have an option to buy a preapproved labor sep 2004. If I buy that, I can file my i-140 right now and It might get approved by May 06 where h1b Expires and apply for 3 yr extension??

I am not sure whether it is worth to buy that labor or just stick with my current labor (05/2002). problem with my current employer is uncertainity about the Job after may 06. If he asks me to go, then everything will come to a halt..
Pls suggest me If I file I140 with Buy out labor, just in case if my current labor is approved sometime before may 06, will i be able to file my i140 from current emp also?
Just confused.. advise pls...........................
