My lawyers sent the letter only a day before final day and therefore am a little concerned if DOL got it in time and marked it correctly or not. Any suggestions?

Did your lawyer contacted BPC? Let us know if he did and once you hear back from BPC, we all will know what stpes to take incase such thing happened.
 
My lawyer faxed/Fed Ed/Email/call BPC, almost week has passed no response. Lawyer told me to wait for 3 months and they take necessary
legal action.

My friend ykuang received the 45-day letter on March 31, 2005.
Her details are:
Virginia SWA
RIR, EB3
PD: Aug 19, 2003
SWA NOF Dec 2004
Replied to SWA Dec 27, 2004
Case processed by SWA and transferred to Philly DOL Jan 6, 2005.
Case was then moved to Philly BPC.
Received 45-day letter on March 31, 2005.
 
What does this mean?

I checked my case status on the lawyer's web site. There is a note about my LC case "03/14/2003: BLS survey (acceptable) received from SO 3/14/03.mi".

What does this mean? My 45-letter arrived on Jan 5. What is this BLS survey?

My company, my lawyer and me all have changed addresses recently. I think my labor is at the BEC right now as I filed my application in Oct 2002 to NY SESA. Can someone help me in how to inform the BEC about this change as they will send the 45 day letter to the wrong addresses. I have no tracking number for my case but the only number that I have is when I requested for a letter from SESA for my 7th year extension they had a number on that letter. My lawyer, as always clueless. I will greatly appreciate this help.

Your attorney needs to send a G-28 form (available at USCIS website) to the BEC your case is at, if he doesn't know which one, he needs to send to both. He should include as much information about your case as possible

Your employer needs to send a letter to the BEC. In the old days they would send a revised ETA750 form with initials next to the address change. They should include as much information about your case as possible.

You don't matter at this point because you aren't getting the 45-day letter but don't forget to send USCIS an AR-11 change of address form with your new address.

My case is also in MD( Aug 2003). I have not recieved any 45 day. Keep me in the loop if you get the letter. I will let you know if I get.

Same here folks - I'm from MD also. My SWA receipt date is Sept'2003. I understand that I'm a month behind you folks but I would greatly appreciate if you can post the update once you receive your 45-day letter. That will help me estimate timing for my 45-day letter receipt.

Guys don't expect anything anytime soon. Our cases just
made it to BEC so they are in boxes right now. They seem
to process regional cases first, even though it was supposed
to be FIFO per state PD. I am MD Jan 2003 RIR.

Thanks for the info guys. Will monitor case status website of my lawyer. Don't know why the idiots had to wait until the last day to send the letter. Hope DOL looks at the "date sent" for the letters, just like INS and not the "received date", if at all it received late. Thanks.

Seems to me that this survey was used to show your wages fall within the range of your job category.

hello, my case status is transferred to regional office @phili on jul 14 03. my pd is nov 02. I have not received the 45 day letter yet. i am worried if my case is not lost in this transfer process. please share your experiences...
 
Any News on Massachusetts Applications Sent to Philadelphia?

My friend had a regular LC application waiting to be processed in Boston with May 2003 PD. Her lawyer just told her there's no news about it being moved to Philadelphia. Has anyone from MA gotten the "45 day letter," and if so, what's your PD?

Her lawyer told her that even if it did get to the BRC/BEC right now, it'd sit in the queue for another year before being processed. How depressing!

I just read an article at www.Murthy.com that says that Boston will be a "satellite" backlog office, and that it will continue to labor certifications there. Does that mean MA SESA applications won't be transferred to Philly? If so, will a "45 day" letter still be sent?

Currently My labor case has been moved to BPC from . In my company I have got one already approved labor . I am thinking of using that approved labor which exactly fits my profile. My question is, in I140 and 485 stage, can I retain the original PD of the approved labor of the X person.

The answer I believe is YES.
BUT... before you do, answer these questions...

Do you fit the requirements of that labor petition as of the date of that labor petition?
If yes, it's safe to go on otherewise you will have trouble with your 140.

What I mean by that..

If that labor petition was filed in 1999 for a person with 5 years experience in Software Engineering, what I mean is: Did you have 5 years experience in Software Engineering in 1999?
It doesnt matter that you have 5 years NOW, you should have had it at the time of the petition....

If yes, dont bloody be wasting your time here... a friend of mine has already got his green card doing the labor substitution route.
