Phd - MS H1 B Quota - Prediction !!!! Urgent Please

Dear Reader,


I have completed my PhD in US in Dec 2006 and My OPT expires in Jan 2008.

There are 4700 H1 B's qualifying under MS quota is filled till date.

There is a great fear that by the time all applications made by April 2, 2007 will be processed the Masters quota will be full.


1. If I find a job in industry (where Cap applies) and start working on my OPT, by what time you think I should tell them to file my H1 B (in advanced degree quota) ???


I am working in my University on OPT on full time basis. But they are saying they will do the H1 B, one day and on another day they are saying "They will NOT".

H1 B in University has no Cap, but the pay really is bare minimum.


Is it safe for me to leave the academic job, where I can pursuade them to file my H1 B ??


OR Should I go ahead and start applying other H1B's under the cap with some recruiters who can file for me quickly ??


Because if I leave my current job I will not get it back.

Can someone please give some insight on this ?

Hi, I am in a similar situation as you, the only thing is I haven't done a PhD.. I just did my Masters', but my OPT too expires in Jan '08.

I guess nobody knows the answer to whether the 20,000 cap will get exhausted by the time USCIS is done counting the applications received, or shortly after that.. Even USCIS doesn't know any answer to this, so how can anyone else know.. The only thing we can hope and pray for is that the applications received are not normally distributed (i.e. not all the 28000 packets opened will have 4700 US Masters' Cap applications), but the situation is really very tough.. I guess that even if USCIS did not receive enough applications on the first day or second day (i.e. April 2 or 3), then also once the news was out about the crisis, many many students would have panicked and sent their applications.. So by now, USCIS would have received thousands of applications for US Masters' Cap after April 2-3, and I am not even sure whether they are going to accept those packets or just refuse them. I am also one of the late runners, and just sent my application on Saturday, and I guess USCIS will receive it by Monday or Tuesday, and am not sure what is going to happen after that..
 
You should not take chance by leaving your current job...instead make your university official understand that you would take care of all the application charges in order to get H1b. They just have to sign necessary documents and rest of the things would be taken care of by you. (i.e laywer's fee, application charges, etcs). The biggest advantage under current situation for you is that you don't fall under H1b cap. Minimum pay is better than no pay...what do you think.

Yes usually universities will not have to pay lawyer fees, I can take care of University H1B myself.

I work for a University, on my OPT. I did not want to Graduate in December 2006 but I was made to Against my will. Most of the Jobs in Engineering, I was overqualified because of PhD and a lot of experience in Research.


I guess I could just hope and pray that at some point a GC process could start.


However a Lawyer came to our University this semester and told that in Any condition the ACADEMIC H1B ( with no Cap) CANNOT be transferred to an Industrial H1B ( with Cap ).


I have One question:

Does this mean that when I get my Academic H1B, then I will be always stuck with the world of Academia ?? and work for at least initial 4-5 years on a Bare Minimum Pay.

........... If my H1 B can NEVER be Transferred to Industry, then I guess if I get a Job in industry they will have to file a New H1 for me............ and wait for me from April to October for me to start working.

Becase Now all H1B's including the MS-PhD are ending on April 2nd itself.


Universitiy officials and employers know this very well and also know our dependence on H1 B and such laws which says H1B's cannot be transferred., THey have lawyers giving free seminars on Loudspeakers, educating University deans and professors saying that it cannot be transferred.


Upon learning this, they have started offering bare minimum pay. Even the custodian of University gets paid more than Researchers.


Is this Not Salvery ? given a good name of "research" ?


I wonder how long will this continue ?

First of all, You are getting PhD, yet, you don't understand what slavery means.
Decendents of slaves who were FORCED to be in US and FORCED to work under terrible working/living condition are quite insulted.

Second, what are you talking about "at least initial 4-5years" ?
