Hi,

I am a us citizen and I plan on sponsoring my sister to come to the US. She currently lives in Tijuana, Mexico and has a B1/B2 Tourist visa. My house is on the US Side and is about 30 minutes from her house on the mexican side.. So whenever she wants to visit me or go shopping she just crosses over to the US side with her B1/B2 and then when done goes back home in Mexico.

I plan to sponsor her using Family based category 4 and understand that it takes about 12-13 years.:(

My question to you is if I apply now what happens to her B1/B2 ? Will she loose it ? Does she run the risk of loosing it during a visit ? The reason I ask is someone told me that an immigration agent during one of her visits can wrongly assume that she will stay here and take her visa away from her. This is not the case since we will follow the law to the letter but it all depends after all in the state of mind of the agent, any agent during her visit.. Can someone confirm ?

Also,

Her B1/B2 expires in 2010, will she have an issue when applying for a new B1/B2 when she has an application pending for permanent residence ?

If you sponsor her using an I-130, then she does risk losing her B-2 visa. An ICE officer may doubt her intetions to return to Mexico after learning that she is the beneficiary of an immigrant petition.
She also risks in being denied future B-2 visas.
 
File I-130, and if she has problems visiting you, you'll visit her since you live so close, until her priority date becomes current. :)
