I have sent a e-mail to Mr. Rajiv Khanna of www.immigration.com about randomly generated finger print notices by National Scheduler and I have requested him to take the issue to TSC. I have given the SRC numbers to prove the randomness in that mail.

Here is the exact copy of the reply from him:
'Create a petition. Get people to sign it. Monica will put it on line for you. I will make sure it gets to the US Attorney General and other places where it needs to go along with a promise of a law suit. Regards. Rajiv'.

I think Monica is his assistant.

Are you with me to proceed in that direction to create a pitition ? By united we could do it and many frustrated people will be benefited. Future filer will not have these problem what we are facing now. What do you think ?????

Hello,

All I want is justice for Texas filers. What did we do wrong? Why Texas filers should wait longer? Didn't we pay the same fees to INS. Everything is working smoothly in other service centers, people are getting FP notices on time , approvals on time. What is wrong with TSC then?

I guess Mr. Khanna didn't mean a "physical" signature (i.e. on paper). That would be infeasible (as we are spread across so many states).

Remember the petition that was circulating 6 months ago about petitioning to abolish the "1 month stay for visitors" rule? It was online. One had to provide their email ID as a way of signing.

Subject: Randomly Generated Finger Print Notices by National Scheduler at Texas Service Center

Dear Sir/Madam:

Finger Print Scheduling is the first part in the Employment Based I-485 Adjustment of Status which is the final stage in becoming the Permanent Resident. Depending on the applicant’s city and availability of facilities/time slots at a particular Application Support Center (ASC), the National Scheduler (computer) has to generate the Finger Print Notices in the order of INS received the cases. But, it is generating randomly without any order. Thousands of people have affected with this problem. Lucky ones (25-30%) are getting finger prints from 10 days to 2 months time and the approvals in the next 1-5 months. It is taking 6-8 months for whole I-485 process for them. Unlucky ones are waiting for the last 17 months just for FP Notice and it is taking 2 years for whole I-485 process because of the randomness. Otherwise, it would have taken around 16-17 months. Once finger prints are completed he/she could expect the approval in the next 1-5 months. The processing times at other Service Center are getting improved and they are taking 8-11 months but Texas Service Center (TSC) is taking 2 years. Unless there is a miracle, TSC can not achieve Mr. President’s 6-month processing time by 2004 with the current resources/facilities.

The flaw in the National Scheduler exists from the beginning of it’s installation in May ’01. Some people who have filed in Jun ’02 have got approvals and some people who have filed in late Aug ’02 have received Finger Print Notices already.

We have sent many letters/fax to TSC Director about this problem and nothing happened. We think our requests didn’t reach to right person who could escalate the problem to the higher officials. Everyday many people are calling to INS after waiting for more than a year and the Immigration Information Officer’s are saying that it is in the scheduler and they can’t do anything to force the scheduler which is managed by a private agency/contractor. Texas Service Center is unaware of this randomness problem. Unless it is fixed people have to suffer forever. Could you please help us in taking this issue to the TSC Director and so that it could be fixed and thousands of people will be benefited with your kind help.

I need one more favour from all of you...

Unless INS receives request from at least 10-15 attorneys about these problems, INS will not realize about the severity/impact of the problem. Please talk to your attorney to send a inquiry/request to the AILA Liasion Officer at INS. So that INS will realize and try to fix the problem.
We are doing all these efforts for ourselves only.
 
I have sent the draft version petition to Mr. Rajiv Khanna.

His assistant Ms. Monica Aggarwal says that once it is approved by Mr. Rajiv Khanna, she can put it online for people to sign it there. There will be link from this forums so that people get to know about it.
 
As the reply in the letter from the attorney says, that a law suit agaist TSC is going to be filed if they will not respond to this... Count me in this.

My request is to include in the petition- In addition to the FP notices, a complete and through explanation by the Texas Service Center of the logic by which they approve the 485 cases after fingerprinting.

As I have observed, there are a lot of FPs which have been done long ago which are not processed.

So the stress should be on the complete 485 approval process and the explanation of its thorough randomness.

I think TSC owes us all a detailed explanation and a promise to look into all these issues on an urgent basis.

We will all ensure that the online petition gets widest publicity and support..

Dear Sir/Madam:

We wish to bring to your notice about the unexplained delay we the applicants are facing when our I485 application – Adjustment of status to permanent resident, has been pending with Texas Service center for more than a year. . Adjustment of Status is the final stage of processing before, we become a Permanent Resident. We are especially concerned about the scheduling of the Finger Printing.

Finger Printing is the first step of the process of Adjustment of Status of an Employment Based Immigration application. Depending on the applicant’s resident city and availability of facilities or time slots at a particular Application Support Center (ASC), the National Scheduler generates the Finger Print (FP) Notices in the order in which INS received the I485 applications. But, at present, the FP notice is being generated randomly not following any order. Thousands of people have been affected by this randomness. A considerable number (20-25%) of applicants are getting their fingerprinting notices within 10 days to 2 months from the I485 Receipt date. So it is taking only 6 to 8 months for them to receive the I485 approval. There are many unlucky applicants who have been waiting for the last 17 months for their FP Notices. Consequently, it is taking more than 2 years from the I485 Receipt date for the latter group to get their I-485 approval.

We feel that the typical time taken for I485 approval would be 16 to 17 months if the FP notices were to be generated in the order of the receipt dates. Once finger printing is completed the applicant can expect the I485 approval in the next 1 to 5 months. There seems to be no effort to clear the backlog of long waiting applicants, before generating FP notices for the recent applicants.

It seems like this flaw in the National Scheduler existed from the time of its installation in May 2001. Some applicants who have filed their I485 in Jun ’02 have got their approvals! Some applicants who have filed in late Aug ’02 have received Finger Print Notices already!

We have sent many letters /fax to The Director- Texas Service Center about this problem. So far the system does not seem to be improving. Everyday many applicants, who have been waiting for their FP notices, are calling the INS about their FP notice status. All they hear from the Immigration Information Officers’ are that it is the scheduler, which is causing this randomness. They express their inability to override the scheduler, which is apparently managed by a private agency/contractor.

We are not sure whether the management of Texas Service Center is aware of this randomness problem. Unless this is fixed soon, bulk of the applicants have to undergo undue and unfair suffering.

The processing times at all other Service Center have improved and typically they are taking between 8 to 11 months to approve a I485 application. But Texas Service Center is typically taking 2 years to adjudicate on a I485 application. Unless there is a miracle, TSC can not achieve the 6-month processing time for Green Cards by 2004 as promised by our President, with the current resources and facilities.

Could you please help us in resolving this issue? If it could be fixed, thousands of applicants will be benefited by your intervention.
