Petition for kids environment

Hi,

I am quite familiar with the "normal" work visas etc. But now I ran into something were I have no clue and it might even be pure rumor - so I hope it was correct to post in this category.

My wife and I are in the US since 2001. We are both German. First she had an L1 and since I while I am on an H1B. I am waiting for a PERM filed 3 years ago and I extended my H1B every year based on that.

We have 2 kids that are US Citizen. They are 12 & 13. They have been going to school here since 2002.

A friends lawyer recently made a comment to my friend that in our case we could even petition to stay here so that the kids are not removed from their environment - even if our PERM would not go though.

I have never heard of something like that.

And hint ?

No such facility available to you. Your sons can sponser you after thay attain major (21) and have sufficient fund to sponser you.

Cancellation of Removal

There is a process called "Cancellation of Removal."

Pursuant to law, cancellation is available to a non-permanent resident of the United States in any immigration status who

1) Has continuously resided in the United States for at least ten years; and
2) Has been a person of good moral character throughout this time; and
3) Is not otherwise subject to criminal bars arising from a conviction of any crime as outlined; and
4) Establishes that removal would result in "exceptional and extremely unusual hardship" to the alien's spouse, parent, or child who is a United States citizen or legal permanent resident.
