I think it's a great idea to contact Mr Don Nuefeld (CSC director) and Mr Eduardo Aguirre (USCIS director) directly. I went to their web sites and found the following information:

In addition to the efforts we are making to Senators, Congresswomen and Congressmen, and CSC/USCIS directors, I am proposing to go through the following possible channels to get our issue more explosure and visibility. Please add your comments.

1. Seek Assitance from AILA
AILA is a powerful organization which has had strong connection to the congress and USCIS. Take a look of the advocacy they've had. We should voice our concerns on I140 to them and have our issue listed as Action Alert, etc.

To put it at the common place, maybe at the Complaint forum,
I'd like to change as follows:
1) remove CSC specific items to make it nationwide
2) more focus on Fujie Ohata's memo about the concurrent adjudication of I-140 and I-485, which nullify AC-21
3) shorten the letter
4) mention that we have been already working with Congressional members
I will put it later today.

Any comments ?

Dear Ombudsman Prakash Khatri,

First of all we want to thank you for the suggestions given by you to reduce the backlog in the process of immigration related cases and for helping our friends from this forum on 485 processing delays at California Service Center.

We are writing to you regarding the unreasonable delays in adjudication of the Employment-Based I-140 cases at almost all of the Service Centers of the USCIS and USCIS memo, by Director Fujie Ohata dated March 31 2004, which invalidates the PL 106-313 (AC 21 public law) due to concurrent adjudication of I-140 with I-485.

According to CSC’s progress report, CSC is adjudicating the I-140 cases filed before July 2003. Also USCIS has not shown any progress for most of the I-140 cases since August 2003. Please note that the CSC was adjudicating I-140 EB2 cases filed around July 17 2003 as of August 1 2003. Congress has expressed repeatedly that the reasonable adjudication period is 6 months for immigration cases.

As per new USCIS memo of concurrent filing for I-140 and I-485, the cases will be adjudicated concurrently. Even if I-140 is filed concurrently, it will take the same time as adjudicating I-485. Since I-485 is taking anywhere between 24 - 36 months to process in CSC, not adjudicating I-140 before hand will not allow candidates to use AC 21. This defeats the purpose of the AC-21 law. The caveat here is, USCIS interpretation, that candidates could change jobs only if their I-140 petition is approved and I-485 petition is pending for over 180 days. Ideally the candidate should be allowed to change jobs after 180 days has passed by after filing I-140 and I-1485 concurrently, irrespective of I-140 status.

In summary we, as immigration portal community, request you to 1.) Please bring this up with USCIS and expedite I-140 processing so that it will give required relief to non-concurrent I-140 filers as well as the concurrent filers; 2) correct the USCIS interpretation of AC 21; and 3.) request Mr. Don Nuefeld to move some reasonable number of adjudicators to I-140 unit from other units such as I-485 where there has been significant improvement recently.

i agree to all the points above, make the petition nationwide because if there is a change in rule for eg for ac21 it will be nationwide and everyone is suffering from this. dates at nsc for 140 have not moved in 4 months now !!!!!!!!! and well you will get great participation and we will write here to the local congressmen also, so better support politically.

Completely agreed I was thinking we should get help from guys of other
service centers and get the common issues onto the petition letter what do
you say?, for instance I guess NSC is not having date moved, VSC dates are
moving but number of people getting approved is very less.

I guess that should be the final one.

I have forwarded the e-mail I sent to Mr Prakash with subject
recommendations for 140 issues at USCIS (CSC).

May be you should post in complaint forum.
 
I've compiled a complete contact list including all congressmen/women who are in the congress Immigration subcommittee. I've gotten the impression that the congressmen/women will not respond to emails from people outside of their jurisdiction.

For people in California, please voice your concerns to Congressman Elton Gallegly or Congresswoman Linda Sanchez, or Congresswoman Zoe Lofgren or Congressman Howard Berman.

News from Eshoo's office:

I just talked to Peddy, who is in charge of Immigration issue in Eshoo's office today. She told me that, because of our campaign/fax/mail last week, she has initiated an inquiry into the California Service Center last week. CSC is required to respond within 30 days. She said she is going to get back to me once they hear something from the CSC. I guess I will wait another two to three weeks and check back with Peddy.

askgc, what did Mile Honda's office did for your visit? Did they initiate any actions?

Another update, I haven't received any replies from those faxes/emails/mails I did last week. Did anyone get any response?

It sounds great.

The I-485 CSC forum has had several fax campaigns to Anna Eshoo's office about I-485 backlog for the last one year, her office should know how to handle such an issue.
If you talked to the staff in charge of Immigration issue in Palo Alto office, I think she is Ms. Patty Kim.

By the way, I'm back from my vacation, so I start preparing the next campaign.

As I wrote earlier MH office would have faxed our letter, addressed to MH,
to the USCIS. Jeff from MH office took my phone numbers and email details
and said they will contact me if they hear from USCIS.

BTW are you not planning to visit Anna Eshoo's office? I thought
I have talked to you last friday that I will come with you. Any way
let me know what is the next step.

I have not got any responses for the e-mails I have sent yet.
