Perm based on H1-b extension

Got a H1-b 1 year extension based on Pending Perm. If the somehow the Pending Perm is denied, is it OK that the new Perm under new company be applied on the 365 days before the expiration of the H1-b 7th year? Or the Perm has be to applied 365 days before the expiration of the H1-b 6th year?

Yes. The way to think about it is that when you apply for H1 extension beyond 6th year (it could be 7th, 8th, 9th year and so on) the LC (PERM) should have been applied 365 days before that date of extension application.
