Perm and layoffs

Hi all

I have a quick question. Will layoffs impact refiling of traditinally filed cases.

Also my company did not do a company wide layoff...it does department wide layoff ..and not announced ..will this affect perm filing..

In general lay-off trigger DOL a red signal.
 
If the layoffs occurred in similar occupations, the employer either has to offer your job to a laid off worker OR wait 6 months before starting the PERM process. That is clearly outlined on the PERM application form.

really appreciated for the reply. my question is ..how would you define similar occupation.

say for example I work in the same department

Person 1:

Title: application developer
does mainframe, cobol,

person 2:
Title: application developer
does java, and technical support
means this guy fixes BUG from customers

person 3:
Title: application developer
Is a java developer and does not do
support.


Are these three similar jobs ?

Yes according to me they are all similar positions, because they all say application developer. I doubt if DOL cares if your do cobol, java or anything else.

Thanks for the reply..i have a question and I would appreciate for you guys honest opinion. MY labor was filed from New york state August, 2003 and non rir. I was application developer then..now there is already a layoff in the company i guess i will have to wait 6 more months..

i believe with the current perm filing situation I would not mind waiting..however...i have the following questions

1) should I wait for BPC to do it or refile using perm
2) another question is ..What happens if I change my
job title after I file my labor certification..what I file my labor as application and then later on switch to dba

Also guys

The application develper that got laidoff were in a different
geographical location (different state) ...does that mean simmilar job occupation ?????? and the layoff was not nation wide..
 
while I don't know that for sure - different location should not matter because labor is for local market. Otherwise you could transfer labor to anywhere in the country (which we all painfully know does not work).
 
desperate for labor

i heard that people sell pre approved labor certification.
Any idea? Is it worth buying it and how much it would cost ?
 
Pre-approved labor is a huge scam market. Pre-approved labor only exist for schedule A occupations (nurses and physical therapists and university professors). I would tread extremely careful with a pre-approved labor. Employers that have approved labor that they never ended up using do NOT sell them, but offer them as a part of the hiring process if they want to hire you on an approved labor they already have. Buying one from a scammer can cause you lots of problems with USCIS when you apply for the green card...
