PERM Ad process..

My lawyer just told me that it's going to take 6 months to compelete the recruitment process.

two consecutive Sunday ads
Wait for a 30 days.
Run the ad on the company site for 60 days
Run the ad on the commercial site for 30 days
File for job order after receving PW from state
Wait for 30 days.

Is this true? Can the ads be run simulataneosuly? Can job order be filed while the ads are running? Greatly appreciate your help.
 
Completely untrue. All can be done simultaneously. Company website for 60 days??? That's not true either. At least 10 days OR what the number of days that is normally done for that particular company is the requirement. The recruitment process only takes 30 days by doing all of it simultaneously, and then you have to wait 30 daye before filing PERM. Get a new lawyer since this one has no clue what the PERM recruitment requirements are.

Secondly, She says that inorder to file under EB2, the current salary need not be equal to the PW. Is this true?

Can we file a case in PERM while there is an application pending in BEC?
 
Below is the link to the DOL PDF file. Scroll to pages 69-71 or so. All recruitment info. is there. Also, google search "PERM recruitment" and key words like that. That will get you law firm websites where they summarize what's in the DOL document. The salary for the proposed "future" position that you file PERM for has to be equal or higher than the PW. The salary for the PERM position is what matters. It can obviously be the same as your current position and salary, but does not have to. Yes, PERM can be filed while you have the other labor going on. I have read that you need to inform the DOL to NOT cancel the other labor certification to if you pursue PERM. If you do not tell the DOL that, I understand that they will close that application. Check with a lawyer on the exact procedures.

All true, extra days in web page gives less denial, if it is a professional job, advt in journel is mandatory.

Can we file a case in PERM while there is an application pending in BEC? Yes, but you have to withdraw your NRIR/ RIR cases from BEC
 
Actually, advertising in a journal is NOT mandatory, but optional as a replacement for one of the Sunday ads. It's very clearly outlined in the link I provided in an earlier message. The recruitment process is a 30 day process (more is optional) as per DOL requirements, and then an additional 30 days of waiting before filing PERM. So, from the placement of the SWA job order until filing PERM is a 60 day process to meet the requirements (more than 60 days is optional).
