hi, could anybody tell me please if i`m allowed to start college after filing paperwork for adjustment of status based on marriage with a us citizen ?

if yes, do i need some permit(like work permit) from uscis or any other document?

will i be considered an international student or a resident?

does it matter that i was present in us illegally for last 8 months?

I believe you can not study UNTIL you receive your green card. Not in a college anyways...

You can work with an EAD.

You could travel with an AP (though not advisable in your overstay case)

But I believe you need a green card to actually enroll in college.

you will prob be considered an international student as long as your i485 is pending.

and i believe praetorian is right about other questions

yes, you are. You don't need a GC to go to college. Heck, even illegal immigrants go to college. As long as you are paying for your classes.... You, of course, are not eligible for federal financial assistance until you get a GC.

no.

UNtil you get a GC, you will be considered neither. You don't need (and you cannot obtain) F-1 status as an international student. Until you get a GC, you will be treated as a non-resident for tuition purposes, and as a resident for enrollment purposes. IN your first year as a GC holder (depending on a state - all have different rules), you will still be considered non-resident for TUITION purposes.

no, it does not. You will have to show them your I-485 notice of receipt, if they ask.

Check what your school policies are. As soon as I got my receipts I was able to start college, you are considerer legal while your paper work is being processed. Most schools have a form you can submit asking them to give you in state tuition. Specially if your spouse is a citizen and claiming you in his/her taxes. Right now I am in a two year program for nursing.

thnx for your reply. are you saying it is possible to get in-state tuition while my i-485 is pending? i`ve been in california for over a year now(that`s the residency requirement here - 1 year) and have many documents(such as bank statements sent to my california address) to prove that. i even have california driver license.

Lucy, thnx for reply. still wonder if there is a chance to get in-state tuition in california community college. i e-mailed a couple of colleges, but haven`t got any reply yet.
 
each state has a different rule. As far as I know CA is very specific about 1 year as a resident rule. Search google, lots of colleges explain the policy in detail.
 
Resident status for college does not mean resident of the USA, but resident of the state in which you live. It's best to call your school to see what documents are needed in order to get the resident rate.

I can barely remember what I needed, but I think it was bank statements, phone bills for 12 months etc. can't remember anything else.

You will be able to go to school without your GC, paying the resident rate is another.

Well let me speak on behalf on NY. NY allows you the right to attend univeristy/college regardless of status, that's a fact and a law.
